NHTSA slaps BMW with $40M fine for slow Mini recall

BMW is on the hook for a $40-million fine after the National Highway Traffic Safety Administration slapped the automaker over not recalling Minis that failed to meet minimum side-impact crash standards. The civil penalty from NHTSA concerns 2014 and 2015 Mini Cooper hatchback models that "failed a crash test designed to determine whether the vehicle met crash-protection minimums," the government agency said in a press release issued this week. An October 2014 test revealed the first problem, and the Mini was subsequently retested in July, only to fail again and finally prompt a recall of more than 30,000 cars. But according to NHTSA's investigation that was opened in October, BMW waited too long to issue a recall after it knew the cars did not meet standards and bring them into compliance with more energy-absorbing materials installed by Mini dealers. This is the second time NHTSA slapped BMW with a major penalty, following a $3-million fine back in 2012 failing to report recalls of its cars and motorcycles. "For the second time in three years, BMW has been penalized for failing to meet that obligation," NHTSA Administrator Mark Rosekind said in the release. "The company must take this opportunity to reform its procedures and its culture to put safety where it belongs: at the top of its priority list." In a separate release issued this week, BMW Group said it, "is committed to further improving its recall processes to better serve its customers," and that the company, "respects the role of NHTSA and looks forward to working with them to develop solutions for the future." Under terms of a Consent Order issued to BMW, the company acknowledges that it violated requirements to issue a timely recall of vehicles that did not comply with minimum crash protection standards, to notify owners of recalls in a timely fashion, and to provide accurate information about its recalls to NHTSA. NHTSA imposed a $3 million civil penalty to BMW in 2012 for similar violations.

Mini devoted one line in the middle of its SEMA press release to the limited-edition Ice Blue Cooper S Hardtop on show at SEMA. We'll give it a few more lines: the Ice Blue hue hasn't been available since 2013, and Mini's being coy about how long the color will hang around. Available on two-door Cooper models, the Ice Blue package adds optional features beyond color, like custom wheel caps and Mini Connected, and adds a few thousand dollars to the MSRP depending on which Cooper you start with. Ready for the big Mini news? The John Cooper Works Tuning Kit will soon be available for Cooper S and Cooper S ALL4 Countryman and Clubman; before now, the kit could only be had for the Cooper S hardtop and convertible. The kit juices horsepower up to 208 hp from 189 hp, and throws in another 14 pound-feet of torque to top out at 221 lb-ft. The stainless-steel exhaust reduces exhaust gas back pressure, and can be controlled via Bluetooth for Sport or Sport+ auditory response. Sport, we're told, is safe for any road, while Sport+ makes a track-only kind of cacophony. The back-end growl gets piped through either chrome or carbon fiber tailpipes. The JCW Tuning Kit goes on sale in January 2018 for $1,950, and can be installed at any Mini dealer. Mini and John Cooper Works floating hub caps are factory fresh accessories

Much of the allure of a Mini is tied to its iconic style and design. Beyond the legendary shape of the Mini Cooper, the company is heavy into unique details that celebrate the brand's heritage. Features such as Union Jack taillamps scream, "Look, I'm British!" while a new accessory inches even closer to the nose and says, "Look, I'm a Mini!" Literally, these new self-leveling hub caps read, "MINI" or "John Cooper Works."  Floating, or self-leveling, hub caps are not new, but they're new to the Mini Original Accessory store. For those who are unaware, these items use weights in the front of the center cap and a "flexible connection to the wheel hub extension" to keep the outermost part of the cap in one position. That position keeps whatever script is written on the cap horizontal and visible to all onlookers.  Mini says the standard wheel covers are easily removed and can quickly be changed out for these floating caps. The Mini cap takes uses a simple black background with chrome trim and script while the John Cooper Works caps have a black background, red outline, and silver, black, and red logo in the center.
