Toyota recalls 2016 RAV4, RX350, and ES350 for stability failure

The Basics: Toyota will recall 4,170 examples of the 2016 RAV4, 90 units of the 2016 Lexus RX350, and 12,400 units of the 2016 ES350. The Problem: A component in the brake actuator assembly may have damage from a manufacturing error. The actuator controls the anti-lock brakes, traction control, stability control, and other systems. If the part doesn't work properly these safety systems might not activate properly. Accidents/Injuries: Toyota spokesperson Amanda Rice told Autoblog, "Regarding the recent recalls, alleged crashes, injuries, and fatalities are reported in many ways to many different organizations. We are not providing specifics at this time." The Fix: Dealers will check the brake actuator's serial number and will replace it if the part comes from a period when the damage could have happened. The involved vehicles are equipped with a Brake Actuator assembly that enables enhanced brake control functions including the Anti-lock Braking System (ABS), Traction Control (TRAC), and Vehicle Stability Control (VSC), among others. There is a possibility that a component inside the actuator could have been damaged during manufacturing, preventing the actuator from operating properly. This could cause a loss of vehicle stability control, increasing the risk of crash. All known owners of the affected Toyota vehicles will be notified by first class mail. Toyota and Lexus dealers will check the serial number of the Brake Actuator and replace actuators assembled during a specific production period. Information about automotive recalls, including but not limited to the list of involved vehicles, is subject to change over time. The organization tests a number of vehicles each year and surveys its members on various automotive topics, including reliability. The results of its 2022 annual auto survey are in, and the list of most reliable vehicles has been revealed. Unsurprisingly, Toyota and Lexus dominated the list of most reliable vehicles, but BMW and Mini snuck into the top 10 as well. Their average score is 58, which is notably better than SUVs’ average score of 51. Minivans and pickup trucks are lower, at 44 and 39, respectively. As Consumer Reports notes, many sedans are older models that have allowed their manufacturers to iron out the wrinkles, making them more reliable. Domestic automakers' SUVs and trucks performed better in the survey than their imported counterparts, with scores of 45 and 41, respectively. The study also showed that hybrids and plug-in hybrids are becoming more reliable, and have climbed the score ladder to the tops of their segments in many cases.  Consumer Reports says its study includes 17 trouble areas, including small stuff like creaks and rattles and much larger problems like drivetrain failures. The organization states that it weights each issue based on its severity to create its predicted reliability scores, with 100 being the best. A car must be in production for at least two model years to be considered for the list. Judge halts Toyota unintended acceleration cases, triggers time for settlement negotiations

So far, the lawsuits brought forth against Toyota for unintended acceleration have gone both ways: the automaker was found not at fault in a 2009 California crash and liable for a 2007 crash in Oklahoma. Both cases involved a Camry and resulted in fatalities. With a big chunk of these UA cases (around 200) set to his the docket of US District Judge James V. Selna in Santa Ana, California, Bloomberg is reporting that the judge has halted the lawsuits until March after Toyota and its lawyers have had extra time to try and settle the cases.
According to the article, Toyota is looking to take care of the cases out of court with an "intensive settlement process." Having already paid out $1.6 billion in "economic loss" suits, this latest settlement process is aimed at the wrongful death and personal injury cases allegedly associated with unintended acceleration. A hearing for the settlements will be held on January 14 with conferences on the matter commencing in February. There is no word as to when lawsuits may start back up if settlements can't be agreed upon.
