U.S. appeals court preserves $210M Hyundai-Kia fuel economy class settlement

A U.S. appeals court restored a $210 million nationwide class-action settlement for hundreds of thousands of owners of Hyundai Motor Co and Kia Motors Corp vehicles whose fuel economy estimates were inflated. By an 8-3 vote on Thursday, in a case closely watched by class-action lawyers, the 9th U.S. Circuit Court of Appeals in Pasadena, California, said vehicle owners had enough in common to let them settle as a group. It also rejected arguments by owners opposed to the settlement that the claims process was too burdensome, and that lawyers for the class had colluded with the automakers to extract a "sweetheart deal" that undervalued their claims. The case began after the U.S. Environmental Protection Agency found flaws in Hyundai's and Kia's testing procedures, prompting the automakers to lower fuel efficiency estimates for about 900,000 vehicles from the 2011, 2012 and 2013 model years. Lawyers for objecting drivers had no immediate comment. Hyundai said it was grateful for the decision. Kia and its lawyers did not immediately respond to requests for comment. The decision by Circuit Judge Jacqueline Nguyen upheld a settlement approved in June 2015 by U.S. District Judge George Wu in Los Angeles. Wu "made careful findings, which the objectors here largely do not challenge, and which more than support the judgment," Nguyen wrote. The decision reversed a divided three-judge 9th Circuit panel's January 2018 rejection of the settlement and decertification of the class action. That panel said Wu failed to assess whether differences in state laws prevented certification of a nationwide class. It also said used car owners should have been excluded because it was unclear whether they had relied on the South Korean automakers' fuel economy claims. Lawyers had said it would become much harder to obtain nationwide settlements if the panel ruling stood. Nguyen had dissented from the panel ruling. Circuit Judge Sandra Ikuta, who wrote it, dissented on Thursday. Ikuta accused the majority of failing to determine what law should apply to the nationwide class or how the settlement, and thus attorneys' fees, should be valued. "The majority's failure to correct these errors may be beneficial for the class action bar, but it detracts from compliance with Supreme Court precedent," Ikuta wrote. The 9th Circuit covers nine western U.S. states, Guam and the Northern Mariana Islands.

Kia launches 1.0-liter engine in Europe

As emissions regulations get tighter around the world, the automotive industry is seeing a proliferation of small, turbocharged engines to keep up. Kia is hopping into this field, at least in Europe, with its newly announced 1.0-liter turbocharged three-cylinder, and the mill debuts at the upcoming 2015 Geneva Motor Show in the Cee'd GT Line (pictured right). Kia's turbocharged three-cylinder makes 118 horsepower and 127 pound-feet of torque in the Cee'd and goes on sale in the fourth quarter of 2014 across the pond. The Korean brand says that the engine will be offered in more of its products there, but won't announce them until later. The engine is still subject to emissions and fuel economy certification in Europe, but Kia's goal is for it to have 10-15 percent better economy than the current 1.6-liter, direct-injected four-cylinder. To make those goals a reality, the company packs the three-cylinder with technology. Laser-drilled fuel-injection holes provide a more even mixture, and the heads and block have separate thermostats to let them be cooled independently, a decision that allows engineers to tune the temperature of the two parts separately to maximize efficiency. Also, the exhaust manifold is integrated into the design to further lower temperatures. On the Cee'd GT Line, the powertrain gets stop/start, as well. While the Ford Fiesta shows that small engines can work in the US by offering the 1.0-liter EcoBoost with 123 hp and 148 lb-ft of twist, don't expect Kia to try it here anytime soon. Company spokesperson James Hope told Autoblog, "We're always studying the market, but there are no plans at the moment" to bring the mill here. For most new car shoppers, three-row crossovers are little more than a way for the family-minded to avoid succumbing to the minivan stigma. Admit it - the only things that differentiate most larger CUVs from minivans are their lack of sliding side doors and - on most of them - the option of all-wheel drive. Having blossomed into a popular segment with thicker profit margins, though, automakers have plenty of incentive to keep their offerings fresh, and that's exactly why Kia is presenting its 2014 Sorento so soon.
At first glance, the crisply styled utility vehicle seen here appears to be nothing more than a mid-cycle refresh - and not a particularly extensive one, at that. But that's not the case at all. Despite looking very similar to the second-generation vehicle that came on the scene for the 2010 model year, this is an all-new Sorento. Or, more precisely, it's about 80-percent new. Kia says less than 20 percent of the parts have been carried over from the 2013 Sorento, and that's a pretty typical amount for an 'all-new' vehicle generation.
