FCA seeking new trial in Jeep fire case, calls $150M judgement 'grossly excessive'

Fiat Chrysler Automobiles is fighting back after a Decatur County, GA jury ordered the company to pay $150 million to the family of a four-year-old boy that was killed after a 1999 Jeep Grand Cherokee crashed and caught fire. The company is requesting the judge reduce the award, and should Walden's family not agree to the lower sum, that a new trial be held. The Detroit Free Press reports that FCA would be forced to pay $120 million over the death of young Remington Walden, with an extra $30 million being paid to the boy's family. Neither figure sits well with the automaker, though, which called the fine "grossly excessive," and claimed it was in violation of Georgia state law. The judgment stems from FCA's long-running problem with the fuel tanks of certain Jeep models built in the 1990s and 2000s. According to the newspaper, FCA argues that the jury was biased after the Waldens' attorneys played on the their passions and pushed for a big award, saying the wrongful death award was 11 times more than any appeals court has ever upheld. FCA said attorneys for the plaintiffs told the jury to base the settlement on Sergio Marchionne's total compensation, $68 million. FCA also claims in its motion that the young boy's suffering was brief. "A $30-million pain-and-suffering award for what plaintiffs acknowledge was at most one minute of suffering is irrational," the motion, which was obtained by The Detroit Free Press, read. "Where such plainly improper arguments are immediately followed by irrational and stunningly excessive damage awards, there can be no doubt that the jury acted from passion and prejudice." Jim Butler, the attorney for the Waldens, has called the motion "nonsense," although he said the family will accept whatever figure the judge sets.

A Florida family is out a Jeep Cherokee and a brand new cell phone after a Samsung Galaxy Note 7 left on a charger allegedly burst into flames on Monday and destroyed both itself and the Jeep. According to Fox 13, Nathan Dornacher and his wife Lydia were cruising garage sales in St. Petersburg, Florida on Labor Day with their daughter and their service dog. They stopped at home to unload a desk they'd purchased earlier. While they got the desk out of the Cherokee's hatch Nathan left his shiny new Galaxy Note 7 charging in the Jeep's center console. When the family went to leave again to run more errands, they were shocked to see that the Jeep's interior was engulfed in flames and thick black smoke was pouring out of the panel gaps. The St. Petersburg Fire department responded to the Dornachers', but it was too late for the Cherokee. The fire destroyed the vehicle, which was dearly loved by Nathan and heavily modified with aftermarket equipment. The Galaxy Note 7 has gained a nasty reputation for spontaneous combustion since its release in August. Samsung has recalled the phone in ten countries after thirty-five instances of Galaxy Note 7s catching fire or exploding for no good reason were confirmed. Fox 13 received a statement from a Samsung spokesperson after they reported the story about the Dornachers' poor jeep. "We are aware of the incident and we are working with Mr. Dornacher to investigate his case and ensure we do everything we can for him. Consumer safety is Samsung's highest priority. With regard to the Galaxy Note7, we are asking owners to take advantage of the Product Exchange Program announced on Friday of last week. Jeep Wagoneer, Grand Wagoneer, and pickup confirmed for production, all built in the US

Jeep has confirmed some much-anticipated future models: a new Wagoneer and Grand Wagoneer as well as a pickup truck, which we expect to be based on the Wrangler. FCA has also announced where these new vehicles be produced, the investment involved, and that adding the models will create 2,000 American jobs. The Wagoneers will be built at FCA's Warren Truck Assembly Plant in Michigan, which currently produces the Ram 1500. The overhaul required to add the Jeeps will also set the plant up to build Ram Heavy Duty models, which are currently made in Mexico. (It's not clear whether this would be additional Heavy Duty capacity or a complete move of production of those trucks to the US.) The confirmed Jeep pickup will be built at the Toledo Assembly Complex in Ohio as expected. This is the same plant that builds Wranglers today and will produce the new JL Wrangler that the pickup version is expected to use. View 30 Photos All of these factory upgrades are part of a $1 billion investment by FCA. The retooling is scheduled to be completed by 2020, which means these models are likely to come online for the 2021 model year, which jibes with the rumors that the Wagoneers have been delayed. That the large Jeeps will be built at the plant that currently produces Ram 1500s also leads us to believe that they will in fact use a version of the Ram truck platform instead of being built off the Grand Cherokee platform as originally planned. The timing of this announcement and its mention of Mexico and US jobs may have something to do with recent talk from President-elect Trump about US auto industry jobs and possible tariffs to be imposed on vehicles built across the border. Marchionne says these plans have been in discussion "for some time" but it's not clear what that timeframe was. Trump has targeted Ford, General Motors, and Toyota in recent tweets but has stayed quiet on FCA. While the announcement may have been political in nature, Jeep fans will no doubt welcome the news of the returning nameplates and the long-awaited pickup model.
