$40M award for boy's death in Jeep fire upheld by Georgia high court

The Georgia Supreme Court on Thursday unanimously upheld a $40 million award to the family of a 4-year-old boy killed in 2012 when the 1999 Jeep Grand Cherokee in which he was riding was rear-ended and burst into flames. A lower court in 2015 reduced a jury verdict from nearly $150 million to $40 million. Fiat Chrysler spokesman Michael Palese said the company was "disappointed in this decision. We are considering our legal options." The Jeep's fuel tank was placed near the back of the vehicle, which plaintiffs said made it vulnerable to rear-end collisions. The Supreme Court ruling said "evidence showed that Chrysler had long known that mounting a gas tank behind the rear axle was dangerous. Evidence also showed that Chrysler's placement of the gas tank behind the rear axle was contrary to industry trends, which favored placing tanks in front of the rear axle." Fiat Chrysler lawyers said during the trial that the fire did not cause Walden's death and blamed the driver of the pickup truck that hit the vehicle. The company said Thursday it "continues to extend sympathies to the family of Remi Walden for their loss." On appeal, the company contended it was prejudicial to raise Fiat Chrysler Chief Executive Sergio Marchionne's compensation, which totaled more than $68 million, according to a company executive who testified at trial. The automaker had denied there was a safety issue and has said the vehicles were no more dangerous than comparable SUVs built at the time. The National Highway Traffic Safety Administration (NHTSA) linked more than 50 deaths to the Jeep fuel-tank issue. Under government pressure, Fiat Chrysler recalled 1.56 million 2002-07 Jeep Liberty and 1993-2004 Jeep Grand Cherokee SUVs in June 2013 to address fire risks and agreed to install trailer hitches to protect the gas tanks. The recall and a "customer satisfaction campaign" that covered the Jeep in the fatal Georgia crash occurred after Marchionne held private talks with senior U.S. Transportation Department officials in 2013. The Georgia Supreme Court opinion said the award was proper in part because Marchionne was "alleged to have specifically interjected himself in a federal safety investigation to the detriment" of the Walden family. In 2015, NHTSA announced Fiat Chrysler would pay a then-record $105 million civil penalty over lapses in safety recalls involving millions of vehicles, including older Jeep SUVs for fire risks. FCA and ZF issue recall on nine-speed automatic transmission

After years of complaints, German transmission manufacturer ZF is finally issuing a recall of its much maligned 9HP nine-speed automatic transmission. Although it has been criticized for a number of issues, ZF is issuing the recall to address the possibility of the transmission unexpectedly shifting into neutral. The issue covers 505,000 vehicles in the United States alone. This issue is related to an improper crimp on the transmission wiring harness. Rather than a physical fix, ZF is issuing a software update to remedy the problem. The company doesn't recommend dealers attempt to fix the crimp. Although the transmission can be found in a number of models by various manufacturers, currently only those from FCA are being recalled. This is the second recall in less than a year related to a ZF transmission shifting into neutral. FCA recently recalled more than a million vehicles worldwide because of a poorly designed shifter for ZF's 8HP eight-speed automatic. That issue may have resulted in the death of actor Anton Yelchin in June. Although there are no deaths related to this new recall, NHTSA reports that the issue has resulted in at least 10 injuries. Issues with the transmission have been known for years. A number of software updates have attempted to address various problems, making us wonder if there could be a fundamental hardware issue as the complaints span across a number of automakers. Vehicles equipped with the 9HP include 2014 and newer versions of the V6 Acura TLX, Chrysler 200, Fiat 500X, upper-level Honda Pilots, Jeep Cherokee and Renegade, Land Rover Discovery Sport and Range Rover Evoque, and Ram ProMaster City. FCA recalling 63k Jeeps, Vipers and Ram ProMaster City vans

Fiat Chrysler Automobiles has announced a pair of recalls cover nearly 63,000 vehicles. The bigger of the two actions covers manual-transmission-equipped vehicles from 2006, including the Jeep Liberty and Wrangler, as well as the Dodge Viper. FCA engineers uncovered that the clutch ignition interlock switches use a kind of wire that was part of a previous recall campaign. Because of this, the company said that affected vehicles may not start, although in rare cases, "if recommended starting procedures are not followed," the affected vehicles may lurch forward after turning the key. Those recommended starting procedures "include activating the parking brake, placing the shift lever in neutral and pressing the clutch pedal before turning the vehicle's ignition key." Recall number two affects the company's 2015 Ram ProMaster City cargo and passenger vans. Owners will need to report to dealers to have a piece of tape removed from the side-curtain airbags. The tape is added during assembly and in some cases, may not have been removed. That could prevent the airbags from deploying in the event of a crash. Just under 59,000 vehicles are included in the first recall, including 43,874 in the United States, 11,309 outside of North America, 2,944 in Canada and 706 in Mexico. The ProMaster City recall includes just over 3,900 vehicles. FCA claims it's unaware of any injuries, fatalities or accidents related to either recall and will perform repairs free of charge. The Company will replace their clutch ignition interlock switches at no charge to customers. The action follows an investigation by FCA US engineers that discovered these vehicles are equipped with switches that contain a certain type of wire implicated in a previous campaign. The wire, which was temporarily substituted by a supplier for the specified material, may break. As a result, the vehicles may not start, and in rare cases – if recommended starting procedures are not followed – a vehicle may exhibit unintended movement when its ignition key is turned. FCA US is unaware of aware of any related injuries or accidents involving this population of vehicles.
