Georgia jury awards $150 million in Jeep fire case

FCA US continues to fight allegations that some Jeep Grand Cherokee and Liberty sport-utility vehicles are unsafe because of the possibility of fires in rear-end collisions. In one recently decided case, a jury in Georgia awarded $150 million in damages to a family whose child died in a blaze in 2012 in a 1999 Grand Cherokee. The jury believed that FCA acted with "reckless and wanton disregard," and didn't do enough to warn owners, according to Reuters. The automaker was found liable for 99 percent of the damages, and the remaining one percent was for the driver who rear-ended the family's SUV. In a statement from FCA US, the company said that it is considering an appeal. Under Georgia law, the automaker was allegedly unable to present a three-year investigation of rear-impact data to jurors. This was the same information the National Highway Traffic Safety Administration used to decide that the '99 Grand Cherokee "did not pose an unreasonable risk to motor vehicle safety." The original recall for the models covered 1.56 million examples of the 2002-2007 Liberty and 1993-1998 Grand Cherokee. With the fuel tank located between the rear axle and bumper, NHTSA and FCA eventually agreed to install a trailer hitch for extra protection. A further 1.2 million 1999-2004 Grand Cherokees owners received notice of a customer service action to have their vehicles inspected, though no hitch installed. Subsequent tests showed this remedy to be effective for impacts below 40 miles per hour. The automaker has maintained the SUVs met the applicable safety standards of the period when they were built. The company was chastised by NHTSA last year for low repair rates of the problem. Feds chastise Marchionne over Jeep recall, only 13% repaired so far

Following the significant outcry surrounding the General Motors and Takata airbag safety crises this year, the National Highway Traffic Safety Administration seems to be taking a much more aggressive role in pushing owners to repair their recalled vehicles. In the agency's latest move, it's urging Jeep drivers to get their models fixed. Acting NHTSA administrator David Friedman even sent a letter to Fiat Chrysler Automobiles CEO Sergio Marchionne pressing him to get more of the SUVs fixed. The problem goes back to the recall of the 2002-2007 Liberty and 1993-1998 Grand Cherokee because of the possibility for the fuel tank to rupture in some rear crashes. The campaign affected over 1.5 million vehicles, but Chrysler initially refused NHTSA's request for a repair campaign. The automaker eventually came up with a fix that involved adding a trailer hitch to provide extra protection to the tank. The feds believe the danger "will be reduced by the remedy now offered by Chrysler," according to the statement. However, this latest push comes out of NHTSA's concern that only three percent of the affected vehicles are repaired, although Chrysler maintains some 13.4 percent have actually been fixed. The agency is asking the automaker to reach out to owners "proactively," and get them to bring the Jeeps in dealers. According to the the feds' statement, the company "has nearly 400,000 parts available" to perform the fixes, and it's still producing more. Friedman's letter to Marchionne goes even further, alleging NHTSA has received reports that dealers are turning customers away who request the recall. He asks the CEO to prove within 15 days that these claims are false. "Given the low rates of repair that Chrysler has reported more than a year after the recall, significantly more aggressive steps are required," says a portion of the note. According to The Detroit News, Chrysler has subsequently promised to speed up the recall work, vowing that all dealers will have at least 12 repair kits in stock by Monday. Further, it has announced plans to ramp up its notification campaign with Facebook ads and public service announcements. FCA applies to trademark 'My Freedom' for subscription service

Almost a year ago to the day, several outlets reported that Fiat Chrysler would trial three car-swapping programs in Boston focused on the Jeep brand. One program covered peer-to-peer Jeep rentals through Turo; another was a three-month subscription service through Avis that allowed Jeep owners to swap for Ram or Dodge vehicles; the third was called "Car Borrowing" and enabled Jeep owners to buy "Jeep Coins" to use on a one-day rental of other Fiat Chrysler products. It's possible FCA is taking last year's lessons to the next phase, CarBuzz having discovered the automaker applied to trademark the term "My Freedom" with the U.S. Patent and Trademark Office. The listed purpose of the mark would be "motor vehicle subscription services, namely, providing temporary use of motor vehicles to members for their personal use." Having begun its research using Jeep, it's not clear if a potential My Freedom subscription service would retain the 4x4 SUV focus or include other brands in the fold; with Jeep's martial origins, the brand has made ample use of the Freedom name over the years. There's also a link to new partner Groupe PSA, as the French automaker's mobility division and subscription service is dubbed Free2Move.   Related: Autoblog's guide to car subscription services   FCA made no comment on the filing, but an analyst at AutoForecast Solutions told The Detroit News that the submission "prepares (FCA) for the future," as. "The idea that autonomy would prevent the need for your own vehicle leads perfectly into subscriptions." U.S. brands haven't cracked the subscription nut yet, even with their premium offerings. Ford bought subscription startup Canvas in 2016, then sold it last year to the car-rental app Fair. GM launch Book by Cadillac in 2016, and shut it down for retooling in 2018 before a re-launch scheduled to happen sometime this year. If nothing else, an FCA subscription program with access to the top-end product could give other-brand luxury owners an easy way to pay attention to Maserati and Alfa Romeo.
