Mahindra fights FCA's Jeep infringement claims

The Indian manufacturer Mahindra is fighting tooth and nail to keep building its Roxor off-road vehicle to sell in the United States. In early August, Jeep mother company FCA filed a complaint with the U.S. International Trade Commission to stop Roxor sales in the U.S. FCA claims the Roxor design is an intellectual property infringement on Jeep design, meant to undercut FCA's own Jeep products on the market. Now Mahindra has released a statement to the commission saying that FCA's complaint is without merit. While FCA stated in its claim that the Roxor is "an imported low-quality knock-off kit car," Mahindra points out that the vehicle took several years to develop and is manufactured in Michigan. Mahindra intends the Roxor to be an off-road vehicle only, and says it does not compete with Jeeps. The Roxor isn't road legal, only comes with a diesel engine and reaches a top speed of only 45 mph. However, it has to be said that the uncomplicated Roxor is far closer to the original ethos of WWII-era Jeeps than the Jeeps FCA currently manufactures. Mahindra also states that FCA agreed in 2009 not to bring about infringement claims as long as Mahindra used a grille design that FCA approved — going with a grille design that clearly differs from the classic Jeep trademark grille. The matter might partially muddled by the fact that the grille agreement was made with 2009's Chrysler instead of today's FCA. Looking back several decades, the entire Mahindra Roxor appearance is at its core based on a 1940s license agreement made with Willys, the original Jeep manufacturer. Mahindra's statement addresses FCA as "Fiat," and it should not be forgotten that Fiat itself manufactured a Jeep lookalike, the Campagnola, from 1951 to 1973 — also with a different grille. Fiat Industrial subsidiary Iveco's history page says the 1951 Campagnola was constructed "according to the Willys mould". Mahindra claims that FCA is using the complaint to create negative publicity to damage Mahindra's reputation. The Indian manufacturer reminds us that it is the first automotive OEM to set up a new manufacturing operation in southeast Michigan in over 25 years — in Auburn Hills, not far from FCA's U.S. headquarters. The Jeep Cherokee Dakar concept showed off at the 2014 Easter Jeep Safari made a lot of online friends, even the Cherokee naysayers assenting that there's a monster Jeep underneath the Cherokee's skin if you're willing to go in and get it. But after reading Road & Track's write-up of what went into creating the Dakar, particularly its lift, you'll understand why you'll probably never see the components for it in the Jeep Performance Parts catalog.
The concept's press release mentions a "prototype Jeep Performance Parts lift kit, and additional suspension modifications." The short-story explanation is that the front struts on the standard Cherokee weren't engineered to accept any amount of lift, so the long story begins with the phrase, "an entirely new suspension." Fiat Chrysler and the UAW reach tentative labor deal

DETROIT — Fiat Chrysler Automobiles and the United Auto Workers (UAW) union on Saturday announced a tentative agreement for a four-year labor contract, a boost for the automaker as it works to merge with France's Groupe PSA. Italian-American Fiat Chrysler and PSA, the maker of Peugeot and Citroen, last month announced a planned $50 billion merger to create the world's fourth-largest automaker. The tentative agreement with Fiat Chrysler, which is subject to ratification by the union members, follows contracts that the UAW already concluded with Ford Motor Co and General Motors Co. The deal with GM followed a 40-day strike in the United States that virtually shuttered GM's North American operations and cost the automaker $3 billion. The UAW on Saturday said the contract with Fiat Chrysler included a commitment from FCA to invest $9 billion, creating 7,900 new jobs over the course of the four-year contract. Of the $9 billion, $4.5 billion was announced earlier this year, to be invested in five plants and creating 6,500 jobs. Detailed terms of the tentative agreement were not released, but they are expected to echo those under the new contracts with GM and Ford, as the UAW typically uses the first deal as a pattern for the others. "FCA has been a great American success story thanks to the hard work of our members," UAW acting President Rory Gamble said in a statement. "We have achieved substantial gains and job security provisions for the fastest growing auto company in the United States." Ratification is not a sure thing. Rank-and-file UAW members at FCA in 2015 rejected the first version of a contract. In addition, a lawsuit related to a federal corruption probe could also raise doubts among union members about the terms agreed. The federal corruption led GM to file a racketeering lawsuit against FCA, alleging that its rival bribed union officials over many years to corrupt the bargaining process and gain advantages, costing GM billions of dollars. FCA has brushed off the lawsuit as groundless. Under the UAW's deal with GM, the automaker agreed to invest $9 billion in the United States, including $7.7 billion directly in its plants, and to create or retain 9,000 UAW jobs. Ford's contract included commitments to invest more than $6 billion in its U.S. plants and to create or retain more than 8,500 UAW jobs. The deals with GM and Ford also created a pathway to full-time employment for temporary workers and left healthcare insurance coverage unchanged.
