EPA suspected Fiat Chrysler of using 'defeat device' in 2015

U.S. regulators told Fiat Chrysler Automobiles in November 2015 that they suspected some of the automaker's vehicles were equipped with secret software allowing them to violate emission control standards, according to emails disclosed on Friday. The U.S. Environmental Protection Agency and California Air Resources Board accused Fiat Chrysler in January of using the software, known as a "defeat device," to illegally allow excess diesel emissions in 104,000 Jeep Grand Cherokees and Dodge Ram 1500 trucks built between 2014 and 2016. Byron Bunker, director of the EPA's Transportation and Air Quality compliance division, said in a January 2016 email to Fiat Chrysler, obtained by Reuters under the Freedom of Information Act, that he was "very concerned about the unacceptably slow pace" of the automaker's efforts to explain high nitrogen oxide emissions from some of its vehicles. Nitrogen oxide is linked to smog formation and respiratory problems. Bunker's email said the EPA had told Fiat Chrysler officials at a November 2015 meeting that at least one auxiliary emissions control device on the car maker's vehicles appeared to violate the agency's regulations. Mike Dahl, head of vehicle safety and regulatory compliance for Fiat Chrysler's U.S. unit, responded in a separate email that the company was working diligently and understood the EPA's concerns. He added that if the EPA identified Fiat Chrysler vehicles as containing defeat devices it would result in "potentially significant regulatory and commercial consequences." The documents redacted the vehicles named, but two officials briefed on the matter said they referred to diesel models. The EPA's November 2015 meeting with Fiat Chrysler came two months after Volkswagen AG, mired in a major tailpipe emissions scandal, admitted to installing secret defeat device software in hundreds of thousands of U.S. diesel cars to make them appear cleaner than they were on the road.

Fiat Chrysler to get $105M fine from NHTSA for recall woes

The National Highway Traffic Safety Administration is about to send a powerful message to automakers doing business in the United States, assuming reports of an upcoming $105 million fine against Fiat Chrysler Automobiles comes to fruition. In addition to the record-setting monetary fine, according to The Wall Street Journal, FCA will have to accept an independent auditor that will monitor the company's recall and safety processes and will be forced to buy back certain recalled vehicles. In other cases, such as with Jeep Grand Cherokee and Liberty models with gas tanks that could potentially catch fire in certain types of accidents, FCA will offer financial encouragement for owners to get their recall work done or to trade those older vehicles in on new cars, according to the report. FCA could reportedly reduce its fines if it meets certain conditions, though those remain unclear at this time. These actions against FCA are being taken after NHTSA began a probe into the automaker over almost two dozen separate instances where the government claims FCA failed to follow proper procedures for recalls and safety defects. Included in those safety lapses are more than 11 million vehicles currently in customer hands. These penalties and fines are separate from the investigation over security problems with Chrysler's Uconnect system that allowed hackers to obtain remote access into key vehicle systems in 1.4 million vehicles. Aptly-named Hooligans motorcycle gang charged with stealing 150 Jeep Wranglers

Nine members of the Tijuana, Mexico-based Hooligans motorcycle gang are facing federal charges, accused of stealing 150 Jeep Wranglers in San Diego County, then moving them across the border, where they were sold or stripped for parts. "The joy ride is over for these Hooligans," said Deputy U.S. Attorney Mark Conover. "For many of us, our cars are our most valuable possessions," he said. "These arrests have put the brakes on an organization that has victimized neighborhoods in a different way, by stealing something very personal, something that has required a lot of sacrifice to purchase." Conover said the gang also stole dozens of motorcycles. The indictment alleges that the gang used old-fashioned shoe leather, a high-tech device, and a specific Chrysler dealership to pull off the thefts. San Diego County faced a rash of Wrangler thefts in 2014. Conover says most of the Jeeps were stolen in the middle of the night, and most were equipped with alarms, yet no alarm ever went off. Police were perplexed about that until they caught a break. On Sept. 26, 2014, a Jeep was stolen out of a driveway in Rancho Bernardo, where a security camera showed the thieves' method. Based on what they saw in the surveillance footage, officers sent Chrysler a list of 20 Jeeps that had been stolen and asked whether anyone had requested duplicate keys - and sure enough, a duplicate had been issued for all 20 - and all from the same dealership, in Cabo San Lucas, Mexico. The indictment alleges that the Hooligans would case a specific Jeep days ahead of stealing it, and would take down its vehicle identification number. Somehow they managed to obtain the secret key codes that would allow them to request a duplicate key for that particular Jeep. During the theft, the indictment says, the Hooligans would disable the alarms system, program the duplicate key using a handheld device, then simply drive away. The fact that Jeeps' engine bays can be easily accessed because of their external latches made the job even easier. (Authorities recommend Jeep owners purchase aftermarket locking latches.) Three of the gang members have been arrested. One was already in custody when two others were arrested this week, one of them at San Diego's massive San Ysidro border crossing. The six others facing charges are still at large and believed to be in Mexico. Seven are US citizens, while two are from Mexico. The collective value of the thefts is estimated at $4.5 million.
