FCA to appeal reduced judgment in Georgia Jeep case

FCA is appealing the $40 million verdict against it in a case in Georgia where a four-year-old boy died in a fire in a Jeep Grand Cherokee, according to The Detroit News. The jury originally awarded the child's family $150 million, but the judge decided to significantly to reduce the amount based on other precedents. The automaker has been considering further legal options since the decision was announced in July. The boy's death happened in 2012 when he was riding in a Grand Cherokee. The vehicle was rear-ended, and the fuel tank burst, causing a fire. This is the same issue that led to a recall of millions of the SUVs and a recent agreement with the US government from FCA to pay to get them fixed. In the original ruling, the jury said that the automaker was 99 percent responsible for the fatality and didn't adequately warn owners. It asked the company to pay $120 million for wrongful death and $30 million for his pain and suffering. FCA countered that the Jeeps met the safety standards of the time they were made. FCA requested that the jury's award be reduced in May calling the amount "grossly excessive." If the family didn't agree to a lower amount, the company also threatened to seek a new trial. Among the arguments was that $30 million was too much for the child's one minute of suffering. The parents did accept the judge's adjusted figure, though.

Star Trek actor's death may be linked to Jeep shifter issue

The tragic death of Anton Yelchin on Sunday may have resulted from a known design flaw with his Jeep Grand Cherokee. The 27-year-old actor, best known for playing Pavel Chekov in the latest Star Trek movies, was reportedly crushed when his vehicle rolled backwards down the driveway in front of his house, pinning him against a brick pillar and metal gate. The 2014-15 Grand Cherokee was one of three models (alongside the Dodge Charger and Chrysler 300 sedans) that Fiat Chrysler recalled this past April due to roll-away risk. The vehicle was equipped with an unintuitive "e-shifter" that didn't deliver the usual tactile response of being shifted into position, leading to numerous drivers exiting the vehicle mistakenly thinking that it was in Park. The problem was reported to have resulted in 41 injuries – and now possibly Yelchin's death as well. The manufacturer stated at the time of the recall that "the vehicles involved in these events were inspected and no evidence of equipment failure was found." It determined that while the vehicle warned occupants if the driver's-side door was opened while the engine was running and the transmission not in the Park position, such measures may have been insufficient. Its remedy for the problem involved updating the vehicle software to better warn drivers in such an event, and changing the design for subsequent models. "Regarding the recall," an FCA spokesman told Autoblog, "I can confirm notices were mailed to affected customers. Included in those notices were tip sheets describing proper operation of the shifter. This supplemental information echoes the instructions in the owner's manual." Yelchin was born March 11, 1989, in St. Petersburg, Russia. His parents were a figure-skating pair, and defected to the United States when Anton was just six months old. In the prime of his career, Yelchin had several films currently in development, including Star Trek Beyond, set to reach theaters next month. Jeep Cherokee recalled to add power liftgate moisture shield

The Basics: Jeep is recalling 55,687 examples of the 2015-2016 Cherokee that have the optional power liftgate and have production dates between February 18, 2015, and September 10, 2015. These include 32,784 vehicles in the US, 10,138 in Canada, 924 in Mexico, and 11,841 outside the NAFTA region. The Problem: Water can potentially leak onto the power liftgate control module and cause a short circuit. This is a potential fire hazard. Injuries/Deaths: Jeep has no reports of injuries or accidents The Fix: Dealers will inspect the area for damage and will replace parts as necessary. They will also install an improved moisture shield that will offer better protection. If You Own One: Owners should try to keep the cargo area of these vehicles dry until dealers perform the recall.
