GM being sued over imploding Bosch fuel pumps in Duramax diesel trucks

Texas-based law firm Hilliard Martinez Gonzalez (HMG) this week filed a class-action lawsuit against General Motors over an alleged issue with Bosch CP4 fuel pumps. The suit claims Bosch designed the CP4 pump to work with European diesel fuel, which is thicker than U.S. diesel. When GM installed that pump in the 6.6-liter Duramax engine used from the 2011 to 2016 model years, the lawsuit claims the thinner U.S. fuel didn't provide enough lubrication, allowing air pockets to form in the fuel pump. That, in turn, allegedly let metal rub against metal inside the pump, causing the pump to eventually disintegrate and "send thousands of metal shards into the fuel injection system and every part of the engine." The Detroit News reported on the most recent lawsuit filed in Michigan's Eastern District Court, but the case is another piece of nationwide legal maneuvering going on since at least last September. Every U.S. truck maker used the Bosch CP4 fuel pump, and HMG originally went after all of them, as well as Bosch. On September 30, 2018, HMG filed a class-action suit in Texas on behalf of eight plaintiffs. The law firm wanted to prosecute the affair under RICO — the Racketeer Influenced and Corrupt Organizations Act — and named 10 defendants: FCA US LLC, FCA North America Holdings, LLC, F/K/A Chrysler Group, Fiat Chrysler Automobiles, N.V., Ford Motor Company, General Motors LLC, Robert Bosch GmbH, Robert Bosch LLC, VM North America, Inc., and VM Motori S.P.A.  The firm filed another suit in Florida on Nov. 2, 2018, against the same 10 defendants, again under the RICO statute, this time on behalf of more than 30 plaintiffs. We don't know how many other suits might have been filed, but the two suits mentioned apparently didn't have legs — the courts dismissed both quickly. So HMG shifted its strategy away from the RICO angle, and focused its efforts on GM, filing suit in California on Nov. 20, 2018. Instead of trying to catch 10 fish with a small net, HMG wants to score one fish with a big net. The results have borne more promise for the plaintiffs. In July this year, a judge in California denied GM's motion to dismiss, noting "the alleged defect is central to the vehicleÂ’s function." This latest suit filed on Aug. 6 in Detroit singles out GM again.  The Bosch CP4 is known to be problematic, however.

Jeep 'trailer hitch' recall repair rates lag amidst reports of new death

The problem with exploding fuel tanks in the 1993-1998 Jeep Grand Cherokee and 2002-2007 Jeep Liberty in some rear collisions continues to be a problem for FCA US, formerly Chrysler. The campaign to fix the utility vehicles was first announced in June 2013 after 51 claimed fatalities, and the fixes reportedly began in January 2014. However, there continue to be new deaths blaming the problem in unrepaired models, according to The Detroit News, citing data from the Center for Auto Safety. The automaker initially refused NHTSA's pressuring to conduct a recall because the models met applicable crash standards when they were manufactured, but eventually, there was a compromise to inspect and fix about 1.56 million Jeeps. With the fuel tank located between the rear axle and bumper, the unusual fix was to install a trailer hitch for extra protection. The National Highway Traffic Safety Administration later agreed that the change would provide added safety in lower to medium speed crashes, but not high-speed crashes. The most recent fatality, according to The Detroit News, occurred on a Michigan freeway in November 2014 when a pregnant woman in a 2003 Liberty was rear-ended when traffic slowed. Her Jeep impacted the vehicle in front, rolled over and a fire resulted. The family reportedly plans to file a lawsuit against FCA. At issue has been the rate at which the vehicles are being fixed. In July 2014, the automaker estimated it could have all of the vehicles repaired by March 2015 thanks to additional hitch supplies. But by November, NHTSA claimed that only three percent of the recalled models had been fixed. FCA says it continues to work to notify owners, though. According to Chrysler spokesperson Eric Mayne to Autoblog, "We are processing approximately 1,200 vehicles per day. Every owner who schedules service is receiving service. As of Jan. 8, that total was 193,490." The company has also mailed out over two million notifications to owners, more than the number officially called in. Given the age of these Jeeps, many of them have had multiple owners, and historically, the older a vehicle is, the less likely the recall fixes are to be carried out. FCA is currently creating a video urging people to have the hitch installed to be released soon. Jeep Cherokee sales rival Wrangler after two months

In our First Drive article on the 2014 Jeep Cherokee we said, "our informal and thoroughly unscientific opinion is they're going to sell tons of them. Why? Because it is very good." So far, it appears the public concurs. Of course, it's very early - the new compact utility has logged just one month of confirmed sales, but Larry Vellequette at Automotive News says dealers have told him that the second month of sales will be even better, a message that mirrors what we've heard from company execs.
In its first, severely truncated month on sale, the Cherokee sold 579 units. With all of November to play with, though, dealers moved 10,169 of them - compared to 11,753 Wranglers and 14,798 Grand Cherokees. That helped propel Jeep to a 30-percent year-on-year improvement for the month, Chrysler Group to a 16-percent improvement and the group's 44th consecutive month of sales growth, exceeding analyst expectations in posting its best November numbers since 2007.
If it can just keep replicating the its first month of sales, the finalist in North American Truck of the Year voting will smoke the trade done by the outgoing Liberty, which didn't break 7,900 units in a month in the last four years of its life (and normally didn't get close to even that). In March this year, Chrysler said it wants to build 250,000 Cherokees in its Toledo assembly plant for global sales. It's early yet, but with second-month sales quoted as being as "strong as death," the bookies might be resetting the odds.
