$40M award for boy's death in Jeep fire upheld by Georgia high court

The Georgia Supreme Court on Thursday unanimously upheld a $40 million award to the family of a 4-year-old boy killed in 2012 when the 1999 Jeep Grand Cherokee in which he was riding was rear-ended and burst into flames. A lower court in 2015 reduced a jury verdict from nearly $150 million to $40 million. Fiat Chrysler spokesman Michael Palese said the company was "disappointed in this decision. We are considering our legal options." The Jeep's fuel tank was placed near the back of the vehicle, which plaintiffs said made it vulnerable to rear-end collisions. The Supreme Court ruling said "evidence showed that Chrysler had long known that mounting a gas tank behind the rear axle was dangerous. Evidence also showed that Chrysler's placement of the gas tank behind the rear axle was contrary to industry trends, which favored placing tanks in front of the rear axle." Fiat Chrysler lawyers said during the trial that the fire did not cause Walden's death and blamed the driver of the pickup truck that hit the vehicle. The company said Thursday it "continues to extend sympathies to the family of Remi Walden for their loss." On appeal, the company contended it was prejudicial to raise Fiat Chrysler Chief Executive Sergio Marchionne's compensation, which totaled more than $68 million, according to a company executive who testified at trial. The automaker had denied there was a safety issue and has said the vehicles were no more dangerous than comparable SUVs built at the time. The National Highway Traffic Safety Administration (NHTSA) linked more than 50 deaths to the Jeep fuel-tank issue. Under government pressure, Fiat Chrysler recalled 1.56 million 2002-07 Jeep Liberty and 1993-2004 Jeep Grand Cherokee SUVs in June 2013 to address fire risks and agreed to install trailer hitches to protect the gas tanks. The recall and a "customer satisfaction campaign" that covered the Jeep in the fatal Georgia crash occurred after Marchionne held private talks with senior U.S. Transportation Department officials in 2013. The Georgia Supreme Court opinion said the award was proper in part because Marchionne was "alleged to have specifically interjected himself in a federal safety investigation to the detriment" of the Walden family. In 2015, NHTSA announced Fiat Chrysler would pay a then-record $105 million civil penalty over lapses in safety recalls involving millions of vehicles, including older Jeep SUVs for fire risks. Chrysler to accelerate production of 2013 Ram and V6 engines

Chrysler is adding a third shift at its Warren Truck plant to meet demand for the new 2013 Ram pickup. And with tight supplies of its Pentastar V6, the company is also boosting output at its Mack Engine plant.
The expansions will add 1,250 jobs and are part of a $238 million investment by Chrysler in the Detroit area. Warren's third shift will begin work sometime in the spring, a Chrysler rep told Automotive News. Mack's increased Pentastar production a could include both 3.6 and 3.2-liter engines.
The company says it also plans to invest $40 million in its Trenton Engine plant to allow for production of a 3.2-liter V6 as well as the Tigershark inline-four for the upcoming Jeep Liberty replacement.

Ford Explorer, Jeep Grand Cherokee flunk IIHS passenger-side crash test

The Insurance Institute for Highway Safety (IIHS) has uncovered major safety-related problems while crash testing a number of popular midsize SUVs. Among those that scored an overall rating of "poor," the lowest possible score, are the Ford Explorer and Jeep Grand Cherokee. Both SUVs showed a high risk of injury to a front passenger during the IIHS' passenger-side small overlap front crash test. This test simulates what might happen if a car or SUV strikes an immovable object, like a telephone pole, at 40 mph and with roughly 25-percent of its front width. "Although some vehicles in this group offer very good protection, in other models, the airbags, safety belts and structure showed serious deficiencies," says IIHS chief research officer, David Zuby. "In those SUVs, a front-seat passenger would be at risk of injuries to the head, hip or leg in a right-side small overlap front crash." In the 2018 Ford Explorer, the front of the SUV showed the structure was "seriously compromised" during both driver- and passenger-side small overlap crash testing, according to the IIHS. The lower and upper door hinge pillar showed intrusion levels of 15 and 13 inches, while the door sill itself was pushed inward 6 inches toward the crash test dummy. The IIHS states these results indicate a high probability that a front occupant would suffer injuries to their right hip and lower left leg. The 2018 Jeep Grand Cherokee didn't fare much better. Not only did the Jeep exhibit 10 inches of intrusion at the lower door hinge pillar, the front passenger crash test dummy's head hit the dashboard through the front airbag. Worse still, the side curtain airbag didn't deploy and the front passenger door opened. The IIHS says there is a strong chance this would result in right leg injuries, along with the possibility of a serious head injury. Even vehicles that earned an "acceptable" in the small overlap front crash test showed definite room for improvement. The 2018 Honda Pilot, for example, showed good structural performance during the crash itself. But the front passenger crash test dummy's head slid off the deployed airbag and hit the dashboard hard, indicating a head injury might result in a similar real-world crash scenario. Two other SUVs that scored "acceptable" ratings included the 2018 Nissan Pathfinder and 2018 Toyota Highlander. Scoring top marks of "good," the highest rating, in these IIHS crash tests were the 2018 Volkswagen Atlas, 2018 GMC Acadia, and 2019 Kia Sorento.
