Jaguar Land Rover seeks to block U.S. imports of Porsche, Audi, Lamborghini, VW SUVs

You wouldn’t know it was about Jags and Lambos, to judge by its rather dry name: In the Matter of Certain Vehicle Control Systems. But thatÂ’s the complaint Jaguar Land Rover Automotive Plc filed on Thursday to block U.S. imports of Porsche, Lamborghini, Audi and Volkswagen sport utility vehicles it says are using its patented Terrain Response technology without permission. Jaguar Land Rover, a British carmaker owned by IndiaÂ’s Tata Motors Ltd., said in its filing with the U.S. International Trade Commission that the technology helps negotiate a “broad range of surfaces” and is a key feature in JaguarÂ’s F-Pace and Land Rover Discovery vehicles. “JLR seeks to protect itself and its United States operations from companies that have injected infringing products into the U.S. market that incorporate, without any license from JLR, technology developed by JLR and protected by its patent,” JaguarÂ’s lawyer, Matthew Moore, said in the filing. Representatives of Volkswagen didnÂ’t immediately respond to emails seeking comment on the complaint. Jaguar wants to block imports of PorscheÂ’s Cayenne; LamborghiniÂ’s Urus; AudiÂ’s Q8, Q7, Q5, A6 Allroad and e-tron vehicles; and VWÂ’s Tiguan vehicles. It said there are plenty of other luxury midsize SUV and compact crossover vehicles to meet consumer demand if the SUVs are banned from the U.S. Still, the premium Porsche and Audi lines provide much of the profit VW is using to fund its investments in technology for electric vehicles, autonomous vehicles and further innovations. In addition to the four brands, Volkswagen Group owns other upscale nameplates, including Bentley and Bugatti. The International Trade Commission is an independent, quasi-judicial agency that investigates complaints of unfair trade practices, like patent infringement. It canÂ’t award damages but does have the power to block products from entering the U.S. Owners of patents and trade secrets like it because it can work faster than the federal district courts -- the typical investigation is completed in 15 to 18 months. But Jaguar also filed patent lawsuits against the companies in federal courts in Delaware and New Jersey, seeking cash compensation for the use of the technology. Those cases are likely to be put on hold once the trade commission launches its investigation. Ride like a royal with Queen Elizabeth II's Jaguar X-Type

The British royal family may be best known for more high-end machinery such as Land Rovers, Bentleys or even King Charles' wine-powered Aston Martin. But not everything was quite so flashy, such as this 2009 Jaguar X-Type wagon, which was owned and driven by the late Queen Elizabeth II. And now it could be yours, since it's heading for auction. We heard about it via Robb Report, and it's being sold by Historic Auctioneers in the U.K. It was very clearly owned by the royal family, as evidenced by the photos of her driving the car, and apparently its initial registration was a royal plate number. We also noticed that in photos of her driving, there's a dog barrier in the back, so the queen's corgis may have been onboard at some point, too. It also has a little over 70,000 miles and has a comprehensive service history. Set aside the royal connection, though, and the X-Type is a relatively unexceptional car. Though it features plenty of Jaguar trimmings from the exterior design, to the wood and leather interior and the J-gate shifter, underneath it was based on the front-wheel-drive Ford Mondeo. In America at the time, that was seen as beneath a luxury brand, particularly to be based on a Ford. Jaguar executives later even admitted that they made some major mistakes with the X-Type, which were rectified with the spiritual successor, the rear-drive XE. The queen's example of the X-Type is, unsurprisingly, about the best-equipped version. It has all-wheel drive and the 3.0-liter gas-powered V6. In the U.S., gas V6s were the only engine options, with a 2.5-liter available early on. It made 227 horsepower and 206 pound-feet of torque. In the U.K., though, there were turbodiesel four-cylinder engines available, as well as front-wheel drive. It also has a lovely tan leather interior with the aforementioned wood trimmings. And being a wagon, it's the most practical. According to Historic Auctioneers, the X-Type wagon was also the first Jag that designer Ian Callum worked on, who went on to revitalize the brand with clean, modern designs for the next decade. The car will be auctioned on November 26 in the Mercedes-Benz World auction. No price estimates were given. With its royal connection, it will surely go for more than your average old Jaguar. NHTSA is investigating FCA shifters for roll-away accidents again, this time the rotary units

It seems FCA's shifter troubles aren't over yet. Now, just a few months after issuing a recall to resolve user-related issues with its monostable shifters, the company is again under investigation by NHTSA. The issue is related to the potential for cars to roll away when the rotary-style shifter is not properly placed in park. Two FCA models are the subject of this investigation: the 2013–2016 Ram 1500 and the 2014–2016 Dodge Durango. NHTSA estimates about 1,000,000 vehicles would be affected if a recall is issued. The investigation was started following 43 complaints of vehicles rolling away while supposedly being in "park." Among the complaints were reports of 25 crashes and 9 injuries. NHTSA does point out that in every incident, the parking brake was not engaged. A representative from FCA also gave us an official statement regarding the investigation: "FCA US is cooperating fully with NHTSA's investigation, the scope of which is limited. Other vehicles equipped with rotary shifters are not included. In accordance with prudent practice, the Company joins NHTSA in urging all drivers to use their vehicles' parking brakes." View 35 Photos As mentioned above, other Chrysler products with rotary shifters, such as the Pacifica minivan and 200 sedan, are not involved in this investigation. One of the key differences, as the representative told us, is that these vehicles have electronic parking brakes that automatically engage if the driver does not select park and then opens the door with the seatbelt unbuckled. The Ram 1500 and Durango feature mechanical, manually operated parking brakes and therefore cannot activate the brake automatically. Because this is currently an investigation, an exact cause for the incidents has yet to be determined, and none of the vehicles have been recalled. It's possible there could be a mechanical defect. However, the issue could be a confusing interface causing user error, as was the case with FCA's monostable shifters, where drivers think they've put the car in park but actually haven't. Something that indicates it could be a case of confused users is that NHTSA also opened an investigation into 2012–2014 Jaguar XF and Land Rover Range Rover Evoques for similar issues. Both vehicles use a rotary shifter and have had roll-away complaints levied as well. Even if it is a case of user error, FCA and Jaguar Land Rover may still have to recall their vehicles.
