Nissan files civil suit against Ghosn, seeking $91 million in damages

TOKYO — Nissan filed a civil suit Wednesday seeking 10 billion yen ($91 million) in damages from the Japanese automaker's former Chairman Carlos Ghosn. Nissan filed the case in Yokohama District Court to recoup some of the monetary damages suffered, it said, “as a result of years of misconduct and fraudulent activity" by Ghosn. The claim was calculated by adding the costs from what Nissan called Ghosn's “corrupt practices,” such as rent for overseas property, use of corporate jets and payments to Ghosn's sister, as well as costs for the internal investigation into Ghosn's alleged wrongdoings. Representatives of Ghosn said in a statement they couldn't comment as they had yet to see the legal documents. “Nissan's maneuvers continue,” they said, while noting Nissan had claimed larger damages before. Ghosn, who led Nissan for two decades and saved it from near-bankruptcy, was arrested in Japan in November 2018, and charged with underreporting his future compensation and breach of trust in diverting Nissan money for personal gain. He was awaiting trial but skipped bail and showed up in Lebanon late last year. Japan has no extradition treaty with Lebanon, and he's unlikely to be arrested. A date had not been set for his trial, and Ghosn has said he was worried his ordeal would never end and he would not get a fair hearing. The bail conditions also barred him from seeing his wife. He has repeatedly lashed out at Japan's judicial system, where the conviction rate is higher than 99%. Japanese authorities recently issued an arrest warrant for Ghosn and three Americans, accused of helping his escape. Separately, they issued an arrest warrant for Ghosn's wife on suspicion of perjury. Ghosn has repeatedly said he is innocent, saying that the promised compensation had never been decided, and all the payments were for legitimate services. Wednesday's lawsuit by Nissan comes on top of the civil case Nissan filed against Ghosn in the British Virgin Islands in August last year. It alleged unauthorized payments, sought to regain a luxury yacht and pursued other damages, according to Nissan. Yokohama-based Nissan, which makes the Z sportscar, Leaf electric car and Infiniti luxury models, is also facing trial in Japan as a company in relation to Ghosn's scandal. It has indicated it will agree to any penalties. Nissan's reputation has been sorely tarnished over the Ghosn fiasco, and its sales have dropped. Nissan reports financial results Thursday.

Nissan recalls 3.5 million vehicles over airbag sensor

Nissan is recalling 3.53 million vehicles globally – 3.2 million in the United States – because the front passenger airbag may or may not deploy properly in the event of a crash. In affected vehicles, the occupant sensing system may not properly register a person sitting in the passenger seat. Passenger-side airbags in roughly 622,000 Nissan Sentra models built between 2013 and 2016 may deploy in crashes when they shouldn't, such as when a child is in the seat. 2016-2017 Nissan Maxima, 2013-2016 Nissan Altima, NV200, and LEAF, 2013-2017 Nissan Pathfinder, 2014-2016 Nissan NV200 Taxi, Infiniti QX60 and Q50, 2014-2017 Nissan Rogue, 2015-2016 Nissan Murano, Chevrolet City Express and 2013 Infiniti JX35 vehicles suffer from the opposite problem. In those models, the airbag may not deploy when it is supposed to. Nissan is aware of at least three crashes where airbags in one of the above models did not function properly, resulting in "moderate injuries." There have already been four recalls since 2013 for similar issues in Nissan vehicles. If you own one of these cars, expect a letter from Nissan in short order (or from GM if you own a Chevy City Express). 2022 Infiniti QX55 Road Test | Yes, crossover coupes can be weekend warriors

SAUGATUCK, Mich. -- We almost didn’t take it. The 2022 Infiniti QX55 wasnÂ’t our first choice for a long weekend getaway to the frozen shores of Lake Michigan. No slight against this stylish crossover -- itÂ’s just not all that big. Especially for two adults, a preschooler, a golden retriever and all of the things needed for a winter vacation. The night before we left, in the drive-through line at CulverÂ’s, we decided: “Hey this thing is really nice. LetÂ’s hope everything fits.” More important decisions have been made with less thought, so the next morning I began packing the QX55. With 26.9 cubic feet, thereÂ’s actually more cargo space than coupe-styled crossovers like the 2022 Audi Q5 Sportback, Mercedes GLC Coupe and BMW X4. Still, the graceful rooflines limit storage capacity for all of these. In my mind, theyÂ’re more commuter crossovers. If you need real space, you would opt for the more upright QX50 and its 31.4 cubic feet of cargo room.  But what the hell is a cubic foot, really? Trunks and cargo areas are often as much about shape as they are about raw volume, and the QX55 turned out to be surprisingly roomy. I wedged a large Samsonite carry-on (19 inches long, 13.5 inches wide), a massive duffle bag, a box of food and stuff, a case of beer, a sled and a few other things, plus two heavy winter parkas laid over the top. For the return trip, we wedged even more stuff in there, including a trash bag filled with laundry and beer from the local brewing scene. On the way there, I could see out the back. ThatÂ’s the tradeoff and something youÂ’ll want to consider if youÂ’re buying something like the QX55. You need to really like the styling, and this segment includes lookers like the X4, which are more compelling visually than their boxier brethren. The QX55 shares InfinitiÂ’s variable compression turbo, which makes 268 hp and 280 lb-ft of torque, so thereÂ’s no compelling powertrain reason to seek out the coupe version.
