Nissan files civil suit against Ghosn, seeking $91 million in damages

TOKYO — Nissan filed a civil suit Wednesday seeking 10 billion yen ($91 million) in damages from the Japanese automaker's former Chairman Carlos Ghosn. Nissan filed the case in Yokohama District Court to recoup some of the monetary damages suffered, it said, “as a result of years of misconduct and fraudulent activity" by Ghosn. The claim was calculated by adding the costs from what Nissan called Ghosn's “corrupt practices,” such as rent for overseas property, use of corporate jets and payments to Ghosn's sister, as well as costs for the internal investigation into Ghosn's alleged wrongdoings. Representatives of Ghosn said in a statement they couldn't comment as they had yet to see the legal documents. “Nissan's maneuvers continue,” they said, while noting Nissan had claimed larger damages before. Ghosn, who led Nissan for two decades and saved it from near-bankruptcy, was arrested in Japan in November 2018, and charged with underreporting his future compensation and breach of trust in diverting Nissan money for personal gain. He was awaiting trial but skipped bail and showed up in Lebanon late last year. Japan has no extradition treaty with Lebanon, and he's unlikely to be arrested. A date had not been set for his trial, and Ghosn has said he was worried his ordeal would never end and he would not get a fair hearing. The bail conditions also barred him from seeing his wife. He has repeatedly lashed out at Japan's judicial system, where the conviction rate is higher than 99%. Japanese authorities recently issued an arrest warrant for Ghosn and three Americans, accused of helping his escape. Separately, they issued an arrest warrant for Ghosn's wife on suspicion of perjury. Ghosn has repeatedly said he is innocent, saying that the promised compensation had never been decided, and all the payments were for legitimate services. Wednesday's lawsuit by Nissan comes on top of the civil case Nissan filed against Ghosn in the British Virgin Islands in August last year. It alleged unauthorized payments, sought to regain a luxury yacht and pursued other damages, according to Nissan. Yokohama-based Nissan, which makes the Z sportscar, Leaf electric car and Infiniti luxury models, is also facing trial in Japan as a company in relation to Ghosn's scandal. It has indicated it will agree to any penalties. Nissan's reputation has been sorely tarnished over the Ghosn fiasco, and its sales have dropped. Nissan reports financial results Thursday.

Lewis Hamilton came to Monaco with a new three-year deal with Mercedes-AMG Petronas and a vow to not let anything, including any "mistakes" by teammate Nico Rosberg, stand in the way of his best qualifying effort. Mercedes reportedly made it rain with a 100-million-pound deal, and Hamilton made it rain right back with his first pole position at Monaco. Rosberg did make a mistake but this time it was behind Hamilton, which meant he stuffed-up the qualifying attempts of rival drivers like Sebastian Vettel. So Rosberg starts second, 0.342 behind Hamilton but 0.449 ahead of Vettel in the Ferrari. Daniel Ricciardo thinks he should have been third, but a communication error with his engineers left him in the wrong engine setting for his final hot lap, so by the very first corner he'd lost the time he would have needed to get higher than fourth on the grid. The second Infiniti Red Bull Racing of Daniil Kvyat slots in behind him, ahead of the second Ferrari of Kimi "Not A Very Happy Day" Raikkonen, who just can't get it going lately. Sergio Perez did for the Sahara Force India what the car can't do on its own, which is grab a top-ten qualifying spot. Toro Rosso rookie Carlos Sainz had qualified eighth but missed a call to the weigh bridge, so he's been slapped into the pit lane. Pastor Maldonado in the Lotus inherits his eighth place, ahead of rookie Max Verstappen in the second Toro Rosso, and Jenson Button in the McLaren. Button only got up there because of two penalties: for Sainz, and Romain Grosjean who had qualified 11th but took a penalty for a gearbox change. When Honda began making zooted-up Civics with big engines and different bodywork in the late 1980s, selling them as Acura Integras in North America and raking in many dollars, Nissan took note. For the 1990 model year and the launch of the Infiniti brand, the luxed-out version of the Euro-market Nissan Primera sedan got Infiniti G20 badging and went on sale over here. After a two-year hiatus in 1997 and 1998, the all-new G20 made its debut for the 1999 model year, and that's what we've got here: a fully equipped Touring version with 5-speed manual transmission, spotted in a Denver boneyard. The G20 Touring got leather seats, a limited-slip differential, and a racy-looking spoiler. Sure looks speedy, though the G20t was less about performance than it was about comfort. G20t buyers got these hep-looking 16" wheels. With just 140 horses from its SR20DE engine (which also went into the quicker Sentra-based machinery of 1999), the G20t wouldn't be beating many of its competitors in drag races.  With the 5-speed manual transmission, though, the stock G20t became tolerably fun. Plenty of G20 owners added more power and threw connecting rods enjoyed sport-compact domination during the early 20th century.
