U.S. appeals court preserves $210M Hyundai-Kia fuel economy class settlement

A U.S. appeals court restored a $210 million nationwide class-action settlement for hundreds of thousands of owners of Hyundai Motor Co and Kia Motors Corp vehicles whose fuel economy estimates were inflated. By an 8-3 vote on Thursday, in a case closely watched by class-action lawyers, the 9th U.S. Circuit Court of Appeals in Pasadena, California, said vehicle owners had enough in common to let them settle as a group. It also rejected arguments by owners opposed to the settlement that the claims process was too burdensome, and that lawyers for the class had colluded with the automakers to extract a "sweetheart deal" that undervalued their claims. The case began after the U.S. Environmental Protection Agency found flaws in Hyundai's and Kia's testing procedures, prompting the automakers to lower fuel efficiency estimates for about 900,000 vehicles from the 2011, 2012 and 2013 model years. Lawyers for objecting drivers had no immediate comment. Hyundai said it was grateful for the decision. Kia and its lawyers did not immediately respond to requests for comment. The decision by Circuit Judge Jacqueline Nguyen upheld a settlement approved in June 2015 by U.S. District Judge George Wu in Los Angeles. Wu "made careful findings, which the objectors here largely do not challenge, and which more than support the judgment," Nguyen wrote. The decision reversed a divided three-judge 9th Circuit panel's January 2018 rejection of the settlement and decertification of the class action. That panel said Wu failed to assess whether differences in state laws prevented certification of a nationwide class. It also said used car owners should have been excluded because it was unclear whether they had relied on the South Korean automakers' fuel economy claims. Lawyers had said it would become much harder to obtain nationwide settlements if the panel ruling stood. Nguyen had dissented from the panel ruling. Circuit Judge Sandra Ikuta, who wrote it, dissented on Thursday. Ikuta accused the majority of failing to determine what law should apply to the nationwide class or how the settlement, and thus attorneys' fees, should be valued. "The majority's failure to correct these errors may be beneficial for the class action bar, but it detracts from compliance with Supreme Court precedent," Ikuta wrote. The 9th Circuit covers nine western U.S. states, Guam and the Northern Mariana Islands.

Hyundai poaches another BMW M exec to run high-performance N division

Hyundai has poached a third executive for its N high-performance division from the ranks of BMW's M department. Thomas Schemera, a 31-year BMW veteran, will head the High Performance Vehicle & Motorsport Division that Hyundai just inaugurated on March 1. Schemera's job will be to "oversee strategy, product planning, sales and marketing for the new division." He will make the most of the transfer from Hyundai Motorsport to the road cars developed by the N division, and work to boost the brand. Schemera has the same boss at N that he did at M: Albert Biermann, the first M exec Hyundai snagged in 2015. After Biermann came Fayez Abdul Rahman, installed at the Genesis brand, who had previously developed platforms for the BMW 7 Series, X models, and M vehicles. Rahman spent the last phase of his BMW tenure in charge of M Equipment, M Sport Packages, and BMW Individual. Although he's undoubtedly busy with his VP job in charge of Genesis architecture development, we hear Hyundai plans to develop some kind of "N Sport" appearance and performance items for release later this year — a middle step in the same vein as M Sport and Audi S-line — and Rahman could certainly help. Schemera brings proven chops when it comes to moving standard and specialty hi-po offerings; as VP in charge of sales and dealer development in China, Schemera oversaw a four-fold increase in BMW and M sales in the four years from 2005-2008. He ended his run as head of BMW M and BMW Individual in the Americas. Although there's but one N product for sale now, the slate is full, and Hyundai looks ready to spend the time and money to seize every opportunity. BMW on the other hand, might soon turn into that tormented significant other regarding its M personnel: "So ... why did you let Hyundai like your Instagram post? Do you like Hyundai? Do you follow them back?!" Porsche, Hyundai and GM impress in J.D. Power Initial Quality Study, Fiat and Jeep don't

Consumers continue to struggle with the advanced user interfaces and technologies being fitted to new cars, according to the latest J.D. Power Initial Quality Study. Overall, the industry average for problems per 100 vehicles climbed three percent, to 116 issues reported in the first 90 days of ownership.
Vehicles from the General Motors' family were dominant, with Buick, Chevrolet and GMC capturing more individual IQS segment awards than any other manufacturer. Despite its well-publicized issues, six GM vehicles (Buick Encore, Chevrolet Malibu, Chevy Silverado HD, Chevy Suburban, GMC Terrain and GMC Yukon) were given IQS awards for their respective segments.
Hyundai was ranked the best overall mass-market brand, with just 94 issues in every 100 vehicles reported in the first 90 days. Parent Hyundai Motor Company, meanwhile, trailed GM with five vehicles winning their segments, including the Hyundai Accent, Elantra and Genesis, as well as the Kia Cadenza and Sportage.
