U.S. appeals court preserves $210M Hyundai-Kia fuel economy class settlement

A U.S. appeals court restored a $210 million nationwide class-action settlement for hundreds of thousands of owners of Hyundai Motor Co and Kia Motors Corp vehicles whose fuel economy estimates were inflated. By an 8-3 vote on Thursday, in a case closely watched by class-action lawyers, the 9th U.S. Circuit Court of Appeals in Pasadena, California, said vehicle owners had enough in common to let them settle as a group. It also rejected arguments by owners opposed to the settlement that the claims process was too burdensome, and that lawyers for the class had colluded with the automakers to extract a "sweetheart deal" that undervalued their claims. The case began after the U.S. Environmental Protection Agency found flaws in Hyundai's and Kia's testing procedures, prompting the automakers to lower fuel efficiency estimates for about 900,000 vehicles from the 2011, 2012 and 2013 model years. Lawyers for objecting drivers had no immediate comment. Hyundai said it was grateful for the decision. Kia and its lawyers did not immediately respond to requests for comment. The decision by Circuit Judge Jacqueline Nguyen upheld a settlement approved in June 2015 by U.S. District Judge George Wu in Los Angeles. Wu "made careful findings, which the objectors here largely do not challenge, and which more than support the judgment," Nguyen wrote. The decision reversed a divided three-judge 9th Circuit panel's January 2018 rejection of the settlement and decertification of the class action. That panel said Wu failed to assess whether differences in state laws prevented certification of a nationwide class. It also said used car owners should have been excluded because it was unclear whether they had relied on the South Korean automakers' fuel economy claims. Lawyers had said it would become much harder to obtain nationwide settlements if the panel ruling stood. Nguyen had dissented from the panel ruling. Circuit Judge Sandra Ikuta, who wrote it, dissented on Thursday. Ikuta accused the majority of failing to determine what law should apply to the nationwide class or how the settlement, and thus attorneys' fees, should be valued. "The majority's failure to correct these errors may be beneficial for the class action bar, but it detracts from compliance with Supreme Court precedent," Ikuta wrote. The 9th Circuit covers nine western U.S. states, Guam and the Northern Mariana Islands.

Hyundai shows off six custom creations in Vegas

Hyundai rolled in to SEMA this year with an array of six customized vehicles. And while it previewed several members of that lineup in the run up to the tuner expo, it has now brought them all together under one roof – namely that of the Las Vegas Convention Center. The fleet consists of three custom creations based on the Tucson crossover, two on the Genesis Coupe, and one on the Veloster. The Tucson lineup includes one by Bisimoto, another by John Pangilinan, and a third by Rockstar Performance Garage. In typical style, Bisimoto cranked the crossover up past 700 horsepower, thanks to a high-boost turbocharger running on flex fuel. Pangilinan crafted his JP Edition Tuscon for off-road adventure with a pop-up tent on the roof, brush guards, and a lifted suspension. And Rockstar went with a Baja-style off-road competition approach with a massive 6-inch lift kit and 32-inch tires. The Genesis Coupes include one by ARK Performance and another by TJIN. The former is dubbed the Solus edition, adopting a dual focus on performance and luxury with a wide body kit, carbon-fiber trim and a supercharged V6 stroked out to 4.0 liters to produce over 500 horsepower. The TJIN edition also ups the output past 500 horses with a supercharger from Bisimoto, plus a free-flowing exhaust, intercooler, and blow-off valve. KW coilover suspension, custom body kit, and green paint job finish it off. Finally, there's the Veloster Turbo R-Spec done up by Blood Type Racing with a black paint job, red racing stripe, carbon-fiber wide-body kit, and a 1.6-liter turbo four boosted up to – you guessed it – over 500 hp. 2015 Hyundai Sonata already recalled for bad wiring harnesses

It's barely arrived in dealerships, and already, Hyundai is recalling its 2015 Sonata. A total of 2,138 vehicles are facing issues with a wiring harness that could limit the amount of power steering help and in some cases, making it difficult to shift out of Park. Most of the cars are not yet in customer hands.
This is a followup action to a very quiet stop-sale that was issued to dealers in early June, which originally included a recall of 1,790 vehicles across the continental US and 58 vehicles in Puerto Rico. That figure eventually grew to a total of 2,080 vehicles in the US and 58 in the Caribbean territory.
Only the 2.4-liter, naturally aspirated model is affected, and of the 2,100-plus sedans, only 12 of them are in the hands of customers, according Hyundai spokesman Jim Trainor. Each customer has been notified and asked to report in for free repairs. As of this writing, there are no reports of injuries or crashes due to the issue.
