Hyundai To Fight $248 Million Judgment Over Fatal Montana Crash

A Montana jury has levied a $248 million ruling against Hyundai in the case of a crash that killed two occupants in July 2011. The automaker plans to appeal the ruling. Cousins Trevor and Tanner Olson were driving a 2005 Hyundai Tiburon when they hit another vehicle head-on. According to lawyers representing their family, the steering knuckle on the car cracked and this allegedly caused it to lose control. Hyundai claimed that fireworks had been let off inside the vehicle, which caused the driver to swerve. The company alleges that evidence that could have proved its innocence was barred from the case. The jury found in favor of the family and awarded them about $8 million in damages after a two-week trial. It claimed that Hyundai had shown "actual malice," according to Reuters. The jurors also slammed Hyundai with a further $240 million in punitive damages. Hyundai told Reuters that it plans to appeal immediately and called the verdict "outrageous." Statement by Hyundai Motor America While a tragic accident, Hyundai firmly believes the jury's verdict in Olson vs. Hyundai is mistaken and award of damages at three times what was sought by the plaintiffs is outrageous and should be overturned as Hyundai is not at fault. Eyewitness testimony established – and experts for both sides agree – that fireworks exploded in the unbelted teenagers' vehicle immediately before the July 2, 2011 accident, which involved the driver losing control, crossing the median and crashing head-on into an oncoming Pontiac at a closing speed of approximately 140 miles per hour – a speed confirmed by experts for both sides. Hyundai believes the jury's view of the evidence was distorted by a series of erroneous rulings by the Court, the most egregious of which prevented the jury from reviewing performance testing conducted by renowned failure analysis experts that would have disproven the plaintiffs' theory of the case – a theory derived by a local resident with no previous automotive experience. It's taken for granted that cars currently for sale in Western countries pass crash tests, and often merit four- or five-star safety ratings in NCAP or NHTSA tests. This is why these scores attained by Indian market cars are so galling: seven vehicles currently sold in India got zero stars in any category – a horrifying clean sweep. It is understandable that cars sold in a developing market are cheap and equipment levels are low, but acceptable crash safety is something that should be considered essential in all markets. The cars tested in the Global New Car Assessment Programme were Hyundai's Eon, Maruti Suzuki's Eeco and Celerio models, Mahindra's Scorpio SUV and several Renault Kwid models. All of the cars were manufactured in India for the Indian market, and the Mahindra Scorpio was the sole larger car. It was first introduced in 2002, with updates made in 2006 and 2014. Mahindra has long planned to export its vehicles to the United States, with the likeliest version a pickup variant of the Scorpio. Renault's Kwid crossover was tested in three versions. Initially, the Kwid was tested with and without airbags, and on both accounts it scored zero stars in adult occupant protection and two stars in child occupant protection. Renault strengthened the bodyshell and the crash tests showed the updated Kwid's structure did not collapse; still, it was rated unstable and that it couldn't withstand further stress. On closer inspection, the structural reinforcements were found to be done only on the driver's side of the passenger cell. Renault has confirmed more safety updates are on their way. "We welcome Renault's efforts to correct this and we look forward to testing another improved version with airbags. Renault has a strong record of achievement in safety in Europe and it should offer the same commitment to its customers in India", says Global NCAP's David Ward. Hyundai Elantra Sport likely to get 201 hp, optional manual

The South Korean market often gives us a preview of what's coming soon from Hyundai and Kia in the US, usually with only the model name differing. That's what we thought when we saw the new Avante Sport being shown there, and Hyundai Motor America spokesman Jim Trainor confirms that it's basically what we should expect from the upcoming Elantra Sport. Hyundai previously confirmed the quicker sedan will arrive in the US by the end of the year. The Avante Sport uses the Veloster Turbo's 1.6-liter turbocharged four-cylinder, making the same 201 horsepower and 195 pound-feet of torque as it does in the funky hatch-coupe. Expect a choice between a seven-speed dual-clutch gearbox and a six-speed manual to go with it. The sporty compact upgrades to a multi-link rear suspension, replacing the standard Elantra/Avante torsion-beam setup. South Korean customers can choose an optional Extreme package that includes upgraded stabilizer bars, different springs and shocks, and a rear spoiler. We're hoping the suspension upgrades will be standard on the Elantra Sport. Hyundai made some subtle visual tweaks to signal the Sport model's extra performance. Lower side sills, larger openings in the front fascia, and a rear diffuser with dual exhaust tips poking out get the speedy message across. Inside, the front seats get larger bolsters and there's a unique flat-bottom steering wheel. Carbon-fiber-esque trim completes the sporty look. Currently, the only Elantra available in the US uses a 2.0-liter four-cylinder running on the Atkinson cycle that makes 147 hp and 132 lb-ft of torque. An Eco trim will join the lineup this spring with a turbocharged 1.4-liter four-cylinder and seven-speed dual-clutch gearbox.
