Hyundai calling in 65k Sonatas over ABS warning light

A problem with the ABS warning light has prompted Hyundai to issue a recall for nearly 65,000 examples of the Sonata sedan. The issue seeks to rectify an issue that would prevent a warning light in the dash from alerting the driver of a malfunction with the anti-lock brakes. The recall campaign specifically affects 2015-16 Sonatas manufactured between May 28, 2014, and August 21, 2015. Hyundai estimates that 64,744 such examples are to be found in the United States. If the warning light doesn't illuminate, the driver may not be aware that there's a problem with the ABS. And, according to the statement below from the National Highway Traffic Safety Administration, that could increase the likelihood of a crash. To fix the issue, Hyundai will notify owners to bring their Sonatas in to their local dealership to have the software in the control unit updated. The recall is scheduled to commence on December 11. The affected vehicles are equipped with an Antilock Braking System (ABS) warning light intended to warn the driver if there is an ABS malfunction. In the event of an ABS malfunction, the Brake System warning light will illuminate, but the ABS warning light will not illuminate. Since the vehicles have ABS malfunction lights that do not illuminate, these vehicles fail to comply with the requirements of Federal Motor Vehicle Safety Standard (FMVSS) number 135, "Light Vehicle Brake Systems." CONSEQUENCE: If the driver is alerted there is a brake system malfunction, but not specifically with the ABS system, the driver may operate the vehicle unaware that the vehicle's brakes may lock up during hard braking, increasing the risk of a crash. REMEDY: Hyundai will notify owners, and dealers will update the ABS control unit software, free of charge. The recall is expected to begin December 11, 2015. 2017 Hyundai Elantra Sport aims to be the Korean Jetta GLI

We've had a good idea of what the upcoming Elantra Sport would be like thanks to Hyundai's reveal of the Avante Sport, the quicker version of the Elantra's Korean-market twin. Now we know just how similar the two are: essentially identical. The Elantra Sport features a turbocharged 1.6-liter four cylinder engine that anyone familiar with the Veloster Turbo will recognize. Oddly though, at 200 hp and 190 lb-ft of torque, the engine is rated 1 horsepower and 5 lb-ft of torque less than either the turbo Veloster or Avante. The front-wheel drive Elantra Sport can also be ordered with either a 6-speed manual or 7-speed dual clutch transmission. We're happy to report the Elantra Sport and its Avante twin will share a new multi-link rear suspension. This replaces the less sophisticated torsion bar suspension and will hopefully contribute to more agile handling. Hyundai did not announce whether the Avante Sport's optional "extreme package" anti-roll bars, springs and shocks would be available in the States. We certainly hope they will at least be an option. The Avante Sport and Elantra Sport will also share exterior and interior updates. These updates give the fastest Elantra a subtle, classy look. Larger intake vents, a rear diffuser panel, larger wheels and slightly extended ground effects all say sporty without shouting it. The theme continues inside with red stitching on the flat-bottom steering wheel and more aggressive "sport" seats. The Elantra Sport also finds itself in an odd position. Many of the performance cars in its size segment have moved up in power. There are some small sedans that come close to the Elantra Sport's 200 ponies such as the turbocharged Honda Civic, 2.5-liter Mazda3 and the lame-duck 2.4-liter Dodge Dart. But when it comes to enthusiast-oriented small sedans with at least 200 horses, there's only one true option: the Volkswagen Jetta GLI. In fact, the 210-horsepower GLI matches the Elantra Sport quite nicely, as it also features subtle styling and just enough sportiness to feel special. Hyundai has yet to announce pricing, but if it undercuts the German veteran by a significant margin, it could become a bargain choice for the driver who wants some, but not too much, fun. U.S. appeals court preserves $210M Hyundai-Kia fuel economy class settlement

A U.S. appeals court restored a $210 million nationwide class-action settlement for hundreds of thousands of owners of Hyundai Motor Co and Kia Motors Corp vehicles whose fuel economy estimates were inflated. By an 8-3 vote on Thursday, in a case closely watched by class-action lawyers, the 9th U.S. Circuit Court of Appeals in Pasadena, California, said vehicle owners had enough in common to let them settle as a group. It also rejected arguments by owners opposed to the settlement that the claims process was too burdensome, and that lawyers for the class had colluded with the automakers to extract a "sweetheart deal" that undervalued their claims. The case began after the U.S. Environmental Protection Agency found flaws in Hyundai's and Kia's testing procedures, prompting the automakers to lower fuel efficiency estimates for about 900,000 vehicles from the 2011, 2012 and 2013 model years. Lawyers for objecting drivers had no immediate comment. Hyundai said it was grateful for the decision. Kia and its lawyers did not immediately respond to requests for comment. The decision by Circuit Judge Jacqueline Nguyen upheld a settlement approved in June 2015 by U.S. District Judge George Wu in Los Angeles. Wu "made careful findings, which the objectors here largely do not challenge, and which more than support the judgment," Nguyen wrote. The decision reversed a divided three-judge 9th Circuit panel's January 2018 rejection of the settlement and decertification of the class action. That panel said Wu failed to assess whether differences in state laws prevented certification of a nationwide class. It also said used car owners should have been excluded because it was unclear whether they had relied on the South Korean automakers' fuel economy claims. Lawyers had said it would become much harder to obtain nationwide settlements if the panel ruling stood. Nguyen had dissented from the panel ruling. Circuit Judge Sandra Ikuta, who wrote it, dissented on Thursday. Ikuta accused the majority of failing to determine what law should apply to the nationwide class or how the settlement, and thus attorneys' fees, should be valued. "The majority's failure to correct these errors may be beneficial for the class action bar, but it detracts from compliance with Supreme Court precedent," Ikuta wrote. The 9th Circuit covers nine western U.S. states, Guam and the Northern Mariana Islands.
