U.S. appeals court preserves $210M Hyundai-Kia fuel economy class settlement

A U.S. appeals court restored a $210 million nationwide class-action settlement for hundreds of thousands of owners of Hyundai Motor Co and Kia Motors Corp vehicles whose fuel economy estimates were inflated. By an 8-3 vote on Thursday, in a case closely watched by class-action lawyers, the 9th U.S. Circuit Court of Appeals in Pasadena, California, said vehicle owners had enough in common to let them settle as a group. It also rejected arguments by owners opposed to the settlement that the claims process was too burdensome, and that lawyers for the class had colluded with the automakers to extract a "sweetheart deal" that undervalued their claims. The case began after the U.S. Environmental Protection Agency found flaws in Hyundai's and Kia's testing procedures, prompting the automakers to lower fuel efficiency estimates for about 900,000 vehicles from the 2011, 2012 and 2013 model years. Lawyers for objecting drivers had no immediate comment. Hyundai said it was grateful for the decision. Kia and its lawyers did not immediately respond to requests for comment. The decision by Circuit Judge Jacqueline Nguyen upheld a settlement approved in June 2015 by U.S. District Judge George Wu in Los Angeles. Wu "made careful findings, which the objectors here largely do not challenge, and which more than support the judgment," Nguyen wrote. The decision reversed a divided three-judge 9th Circuit panel's January 2018 rejection of the settlement and decertification of the class action. That panel said Wu failed to assess whether differences in state laws prevented certification of a nationwide class. It also said used car owners should have been excluded because it was unclear whether they had relied on the South Korean automakers' fuel economy claims. Lawyers had said it would become much harder to obtain nationwide settlements if the panel ruling stood. Nguyen had dissented from the panel ruling. Circuit Judge Sandra Ikuta, who wrote it, dissented on Thursday. Ikuta accused the majority of failing to determine what law should apply to the nationwide class or how the settlement, and thus attorneys' fees, should be valued. "The majority's failure to correct these errors may be beneficial for the class action bar, but it detracts from compliance with Supreme Court precedent," Ikuta wrote. The 9th Circuit covers nine western U.S. states, Guam and the Northern Mariana Islands.

2017 Genesis G90 signals Equus' evolution

As predicted, Hyundai's executive-level Genesis EQ900 has crossed the Pacific to make its big debut at the 2016 Detroit Auto Show. Known in the North American market as the Genesis G90, the first-ever vehicle for the new Genesis brand will occupy the same position as the old Hyundai Equus at the top of the heap. That means lots of interior space, most of which is finished in luxurious materials and stuffed full of technology. From the lone interior image Hyundai sent out, the cabin is clearly an evolution of the Equus' aesthetic. There's a large swath of real wood on the dash, which is topped by Nappa leather. The expansive center display sits atop a high, curving transmission tunnel that houses the traditional knob-and-dial controller for the infotainment, as well as the shift lever and HVAC buttons. Hyundai stretched the G90's wheelbase by 4.5 inches over the old Equus, but in the process, it removed an inch of backseat legroom. Now there's only 37.8 inches in the second row, which doesn't compare favorably to the 42.9 inches in the back of the Audi A8L or the 43.1 inches offered in the Mercedes-Benz S-Class. Unlike the EQ900 that was shown early last month, the US-market G90 will only offer a pair of engines. On the one end, we have a 3.3-liter, twin-turbocharged V6, capable of 365 horsepower and 376 pound-feet of torque. The 5.0-liter V8 from the Equus will be offered too, and it still churns out 420 hp and 383 lb-ft of torque. But with peak twist from the V6 model available between 1,300 and 4,500 rpm and less than 60 horsepower difference between the two engines, it sounds like the smaller engine will be the one to have, especially if it proves significantly lighter (Hyundai hasn't published the G90's weight yet). Both engines are paired to eight-speed automatic transmissions and can be paired with Hyundai's H-TRAC all-wheel-drive system. Look for more on the new G90 from its Detroit debut. 2015 Hyundai Genesis Coupe dumps turbo four, goes V6 only

Hyundai's rear-wheel-drive Genesis Coupe has been soldiering along for several years with the choice of either a turbocharged 2.0-liter four-cylinder or a 3.8-liter V6, but that's about to change. Hyundai Motor America spokesperson Jim Trainor has confirmed to Autoblog: "The 2.0L Turbo engine will be discontinued starting with the 2015 model year, allowing us to reposition Genesis Coupe with its more premium performance buyer."
Rumors of the change first emerged over at The Korean Car Blog, which cited the company's ordering system as proof of the change, and it claims that there are some other changes in store for the 2015 Coupe as well. According to KCB, the base Genesis will use the 3.6 and will continue to be offered with either a six-speed manual or eight-speed automatic. Upgrading to the R-Spec model will add LED running lights, but other exterior appearance changes are unclear. Finally, the Grand Touring version will be dropped entirely, and the Ultimate trim will gain optional brown leather.
