Hyundai Kia asked to pay $28.9M in patent infringement case

After years of litigation, Hyundai and Kia have lost their hybrid technology patent infringement case against Paice LLC. The jury ordered the South Korean automakers to pay $28.9 million, but according to Bloomberg, because the violation was allegedly intentional, the judge could triple that amount. The automakers have announced plans to appeal the ruling. Paice's patent dates from 1994 on a piece of tech called the Hyperdrive, and it was a way to seamlessly switch between power from an electric motor and an internal combustion engine. This lawsuit was first filed in 2012 and covered the systems in the Hyundai Sonata Hybrid and Kia Optima Hybrid. According to Bloomberg, the companies tried to argue that the patent was no longer valid, but the strategy failed. "Hyundai strongly believes its position and will appeal any remaining adverse findings to the Federal Circuit," the company said in a statement to Autoblog. Paice is certainly no stranger to litigating over the Hyperdrive patent, though. It and Toyota had a similar court battle that lasted years. Eventually, there was a settlement, and the result was Paice getting royalties for each hybrid that the Japanese automaker sold. Similarly, there's a lawsuit pending against Ford over tech in the C-Max, Fusion, and Lincoln MKZ. Hyundai Statement: Hyundai believes that the verdict returned by the jury today in the matter of Paice v. Hyundai Motor Company et al., is not supported by the evidence. Accordingly, Hyundai has requested that the presiding judge enter a judgment in its favor notwithstanding the verdict. Hyundai strongly believes its position and will appeal any remaining adverse findings to the Federal Circuit.

Hyundai Sonata PHEV on sale for $34,600, in some states, at least

Hyundai's first plug-in hybrid vehicle is now available in ten US states, and the even better news is that the car can go the equivalent of a marathon, plus a little change, without using a drop of gas. The South Korean automaker says the vehicle will have a 600-mile driving range and will be able to go 27 miles on electric power alone. Other goodies on the safety front include a blind-spot detection system and rear cross-traffic alerts. The sedan pairs a 2.0-liter gas-powered engine and electric motor that combine for 202 horsepower. The car also delivers an estimated 99 miles per gallon equivalent fuel-economy rating. The model's 9.8-kWh battery is five times the size as the one in the Sonata Hybrid. Exactly how well these cars will sell could be a mystery for a little while, as Hyundai and its sister company Kia have steadfastly refused to disclose hybrid-sales figures and this policy might continue with the PHEV. The Sonata PHEV starts at $34,600 before a potential federal-government incentive worth up to $4,919 kicks in. A "limited" trim runs for $4,000 more. The car, whose specifications were largely detailed last month, will be available for sale in California, Connecticut, Maine, Maryland, Massachusetts, New Jersey, New York, Oregon, Rhode Island and Vermont. The reason for this limited roll-out, Hyundai executives have said, is that those states have the best charging infrastructure network for PHEVs. No word on when the rest of the country will be able to easily buy the sedan, though folks in the other 40 states can at least put in special orders for the car. The 2016 Honda Civic sedan, Hyundai Sonata, Lexus RX, and Nissan Altima started the year with a bang by earning Top Safety Pick+ honors from the Insurance Institute for Highway Safety. They join 48 other 2016 model year vehicles that IIHS already tested that received the agency's top safety marks. These four models met the IIHS' latest requirement, scoring the agency's best possible score in all five of its crash tests – front, side, rear, rollover, and the difficult small-overlap – to be eligible for the safety accolade. Hyundai improved the 2016 Sonata's structure after the sedan's production began, so this rating only applied to examples produced after October. To get the TSP+ honor, a vehicle's crash prevention tech needs to earn least two points on the IIHS' scale. The lower Top Safety Pick designation can go to model with a "basic" version of these systems like a front collision warning. The Civic, Sonata, and RX scored the maximum six points to get "superior" scores for their optional crash prevention tech because they avoided collisions at up to 25 miles per hour. The Altima was successful in a 12-mph test, but the system slowed the sedan by 10 mph in the 25-mph test rather than completely stopping it.
