Hawaii is first state to sue Takata

Hawaii became the first state to sue Takata Corp. alleging the company knowingly sold potentially defective airbags in a suit filed May 13. The state also claims Takata covered up data showing the airbags were a danger and then delayed recalling them. Hawaii also named Honda Motor Co., which owns part of Takata, and Honda's US affiliates, American Honda Motor Co., and Honda of America Manufacturing Inc., in the complaint. The state claims Takata switched to lower-cost ammonium nitrate for its airbag inflators, despite internal testing that the propellant was "unpredictable and prone to explode." Hawaii, which brought the suit through its Department of Commerce and Consumer Affairs Office of Consumer Protection, is seeking the maximum civil penalty of $10,000 per violation. It also wants Takata to make restitution to owners, run an educational campaign to spur owners to get their cars fixed, and repay profits made from the faulty airbags. Faulty Takata airbags have killed 13 people and are estimated to have injured more than a 100 more. NHTSA says 28.8 million vehicles with the airbags have been recalled, and potentially 40 million more may need to be recalled. Five vehicles named Top Safety Pick+ including new Civic, MKZ

In an attempt to help push vehicle safety to a higher level, the Insurance Institute for Highway Safety created a stricter Top Safety Pick+ rating last year, which incorporates a brutal small overlap test and requires cars to get Good ratings in four out of the five categories (and no less than Acceptable in the fifth). Joining the list of the safest cars of 2013, the 2013 Volvo XC60, Lincoln MKZ, Honda Civic (sedan and coupe) and the 2014 Mazda6 have all received the coveted TSP+ rating.
The Mazda6 and Lincoln MKZ have both been completely redesigned, and both received Acceptable ratings in the small overlap test. The Honda Civic, coming off its emergency refresh for 2013, is the first small car to be subjected to the small overlap test, and IIHS says that one of the car's many upgrades includes a stiffer front structure allowing it to receive Good ratings in all categories. Similarly, the XC60 gets all Good ratings thanks to, according to IIHS, Volvo updating the airbag software allowing the side airbags to inflate during the small overlap test.
The 2014 Subaru Forester has not yet been subjected to the small overlap test, so it must make do with just a Top Safety Pick rating until the IIHS tests small utility vehicles, which is expected to happen later in the spring.

Honda recalling 748k Odyssey and Pilot models over airbag concern

American Honda today announced a recall of approximately 748,000 Odyssey and Pilot models due to faulty airbag concerns. The vehicles in question are Odyssey minivans from the 2011 to 2013 model years and Pilot crossovers from the 2009 to 2013 model years.
According to a statement from Honda, driver's side airbags in the affected vehicles were potentially assembled without some of the rivets that secure the bag's plastic cover. Because of this, the airbag may not deploy properly in the event of a crash, leading to further occupant injury. As of this writing, no injuries have been reported in conjunction with this issue.
Honda will begin officially notifying owners via mail in mid-February. The automaker urges customers to take their vehicles to an authorized dealership, where vehicles will be inspected and, if necessary, repaired. In lieu of waiting for the snail mail approach, owners may also visit www.recalls.honda.com or can contact the automaker directly at 1.800.999.1009 and select option four.
