Honda fined $70 million for failing to report deaths, injuries

The federal agency charged with keeping US motorists safe announced Thursday it has fined Honda $70 million for failing to report death and injury data in a timely manner. Honda failed to report 1,729 incidents involving death or injury over an 11-year period, according to National Highway Traffic Safety Administration officials. Federal law requires automakers to report deaths, injuries and certain warranty claims. Officials said Thursday that information could have been used to spot trends in automotive defects and potentially save lives. Transportation Secretary Anthony Foxx said it is possible the Department of Justice could conduct a criminal investigation into the failures, but it was not immediately known whether the Justice Department would pursue such charges. NHTSA officials still don't know much about the 1,729 incidents of death or injury that were missing from the Early Warning Reporting records, because in some cases, they still haven't been reported. Mark Rosekind, the agency's new administrator, said Honda is still in the process of sending investigators the missing information. "Our first task will be to review that, and determine actual deaths and injuries," he said. "That data is in the process of coming to us and being processed right now." The $70 million is the largest civil penalty levied against an automaker in history, officials said. It actually consists of two $35 million penalties, the maximum allowed by statute for a single TREAD Act violation. In this case, NHTSA broke the fine into separate violations, one for the missing deaths and injury information and one for the company's failure to report certain warranty-claim information. Honda reached an agreement with the federal government in late December, in which it accepted additional regulatory oversight and third-party audits that will ensure reporting is properly completed in the future. Here are a few of our favorites from this year:1) Porsche Porsche announced that it's launching a Mission E tractor, styled to resemble its 1950s tractor models. "With a power output in excess of 700hp, the Mission E Tractor will be the fastest accelerating agricultural vehicle in the world, enabling farmers to harvest crops in record time with the added environmental benefits of zero emissions at source and significantly reduced operating noise."2) Lexus Lexus actually jumped the gun, telling us on March 28 that it's combining cars and drivers using DNA matching. The kicker was that with DNA-matched cars, owners would be able to start their Lexuses by licking the steering wheel.3) McLaren Automotive McLaren said it's boosting efficiency by quite eccentric measures, such as measuring the technology center's lake and floor tiles daily, and by synchronizing the staff's tea breaks.4) BMW Motorrad BMW's motorcycle arm is solving parts availability issues in remote locations by offering a 3D printer mounted permanently on the bike's rack: If you need to replace a broken-off gear lever, you can just print one. "The new system will mean that even very rarely required parts not generally stocked by BMW Motorrad sales partners can be supplied on a just-in-time basis." BMW even went to the lengths of announcing that the "BMW Motorrad iPart 3D Mobile Printer" was tested on the Antarctic, by erecting a tent whose poles were produced onsite.5) Honda Last but not least, Honda UK purportedly cut the roof off a new CR-V, calling it the CR-V Roadster. Tellingly, no convertible top was even offered for the concept, "making it a no-top rather than a drop-top. Judge allows class-action lawsuits against Honda, automakers

Millions of plaintiffs in 2014 brought a class-action lawsuit in against Takata and Honda, and the airbag manufacturer and carmaker petitioned to have the case thrown out. A US District Judge in Miami ruled against the companies on December 3, allowing the case to proceed. The case in question, Craig Dunn et al vs. Takata Corporation et al, is thought to be the first class action filed in the ongoing airbag imbroglio. Other cases have been filed, but on behalf of individuals. Takata and Honda are named defendants in the case, but the 453-page suit is also aimed at BMW, Ford, Mazda, Nissan, and Subaru. The plaintiffs claim violations of the Racketeer Influenced and Corrupt Organizations (RICO) Act specifically by Takata and Honda, alleging that those two companies conspired to hide information about airbag inflators that could rupture and spray shrapnel around a car's cockpit. Honda said Takata hid information from it and ceased doing business with the airbag company, while a recent Wall Street Journal review of documents indicated that Takata changed testing information to suppress actual results from Honda. The class-action suit charges violations of the Magnuson-Moss Warranty Act, too. Meanwhile, Takata has strengthened its legal team with the addition of Lanny Breuer, a partner at Covington & Burling LLP. Breuer was a US assistant attorney general from 2009 to 2013, heading the criminal division. Honda has been dealing with individual cases out of court, with litigation in cases of five out of six US deaths settled for undisclosed sums.
