Hawaii is first state to sue Takata

Hawaii became the first state to sue Takata Corp. alleging the company knowingly sold potentially defective airbags in a suit filed May 13. The state also claims Takata covered up data showing the airbags were a danger and then delayed recalling them. Hawaii also named Honda Motor Co., which owns part of Takata, and Honda's US affiliates, American Honda Motor Co., and Honda of America Manufacturing Inc., in the complaint. The state claims Takata switched to lower-cost ammonium nitrate for its airbag inflators, despite internal testing that the propellant was "unpredictable and prone to explode." Hawaii, which brought the suit through its Department of Commerce and Consumer Affairs Office of Consumer Protection, is seeking the maximum civil penalty of $10,000 per violation. It also wants Takata to make restitution to owners, run an educational campaign to spur owners to get their cars fixed, and repay profits made from the faulty airbags. Faulty Takata airbags have killed 13 people and are estimated to have injured more than a 100 more. NHTSA says 28.8 million vehicles with the airbags have been recalled, and potentially 40 million more may need to be recalled. Daimler, Toyota, BMW to lead $10-billion hydrogen investment

Daimler, BMW, and Toyota are leading a group of 13 companies pledging to invest more than $10 billion during the next five years to spur enough infrastructure-building and technology advancements to get more of the general public to buy hydrogen fuel-cell vehicles. The automakers, which also include Honda and Hyundai, as well as companies such as Shell, AirLiquide, Linde Group, and Total SA, are part of what they're calling the Hydrogen Council. The group made its announcement in Davos, Switzerland, on Tuesday. The Hydrogen Council will pledge to accelerate its rate of hydrogen-related investments, which currently stand at about $1.5 billion annually. The coalition says its work represents a continuation of the 2015 Paris Agreement, in which many of the companies agreed to address the issue of climate change. The group says that hydrogen, which emits water vapor when used in fuel-cell vehicles, "can play an important role in the transition to a clean, low-carbon, energy system." The Hydrogen Council also vowed to push global governments to accelerate public investment in hydrogen-related infrastructure. Relative to other drivetrain technologies, hydrogen fuel-cell vehicles are in their relative infancy in terms of adoption because of the high cost of both building fuel cell vehicles and setting up a hydrogen-refueling infrastructure. Toyota is the only automaker that sells a production fuel-cell vehicle in the US. The Japanese company, which introduced its Mirai domestically in late 2015, sold 1,034 of them in the US last year. Daimler subsidiary, Mercedes-Benz, used Tuesday's announcement to remind people that it would start selling its GLC plug-in hydrogen fuel-cell crossover this year. There are only 33 publicly accessible hydrogen refueling stations in the US, including 30 in California, and one each in Connecticut, Massachusetts, and South Carolina, according to the US Department of Energy. By comparison, there are more than 15,000 electric-vehicle charging stations with almost 40,000 outlets in the US. Florida woman says Takata airbag deployment left her paralyzed

A malfunctioning Takata airbag left a Florida woman paralyzed from the neck down following an otherwise minor car accident last year, a lawsuit filed last week alleges. Patricia Mincey says in court documents that, instead of deploying normally, the driver-side airbag in her 2001 Honda Civic deployed with such force that it injured her neck and rendered her a quadriplegic. The lawsuit accuses Takata and Honda of deliberately concealing information about the defect and taking belated action to protect Mincey and other motorists from airbags that may harm them instead of saving their lives. At least five deaths and 139 injuries have been linked to the flawed airbags in Honda vehicles. "There is a systemic failure of these companies to come clean with information they know very early on of problems," Ted Leopold, Mincey's attorney, tells Autoblog. "Instead of doing the right thing, they try to sweep the problems under the rug until there are so many deaths and injuries they're left with no choice. We saw it with General Motors ignition switches, we saw it with the Toyota unintended acceleration cases and now we see it here." Long History Of Takata-Related Recalls Four days after Mincey's accident, Honda recalled her car as part of a 5,394,000-vehicle recall that sought to repair vehicles in which the airbag inflators could rupture. Her accident took place in Jacksonville, Florida, a state in which manufacturers have said high humidity could cause a heightened risk of problems for Takata airbags. She was wearing her seat belt at the time of the crash, according to court documents, and her car was traveling approximately 22 miles per hour. Mincey remains hospitalized in a long-term care and rehabilitation facility near her Florida home, her attorney said. She is seeking compensation in excess of $15,000 for her injuries and punitive damages. Problems with the Takata airbags were discovered as early as 2001, when Isuzu issued the first recall related to high-pressure deployments. But the company continued to manufacture defective airbags, which have subsequently been flagged in dozens of recalls over the past 14 years. Approximately 21 million vehicles have been affected in the United States. Congress conducted hearings on the companies' delayed responses to the safety crisis last year.
