GM being sued over imploding Bosch fuel pumps in Duramax diesel trucks

Texas-based law firm Hilliard Martinez Gonzalez (HMG) this week filed a class-action lawsuit against General Motors over an alleged issue with Bosch CP4 fuel pumps. The suit claims Bosch designed the CP4 pump to work with European diesel fuel, which is thicker than U.S. diesel. When GM installed that pump in the 6.6-liter Duramax engine used from the 2011 to 2016 model years, the lawsuit claims the thinner U.S. fuel didn't provide enough lubrication, allowing air pockets to form in the fuel pump. That, in turn, allegedly let metal rub against metal inside the pump, causing the pump to eventually disintegrate and "send thousands of metal shards into the fuel injection system and every part of the engine." The Detroit News reported on the most recent lawsuit filed in Michigan's Eastern District Court, but the case is another piece of nationwide legal maneuvering going on since at least last September. Every U.S. truck maker used the Bosch CP4 fuel pump, and HMG originally went after all of them, as well as Bosch. On September 30, 2018, HMG filed a class-action suit in Texas on behalf of eight plaintiffs. The law firm wanted to prosecute the affair under RICO — the Racketeer Influenced and Corrupt Organizations Act — and named 10 defendants: FCA US LLC, FCA North America Holdings, LLC, F/K/A Chrysler Group, Fiat Chrysler Automobiles, N.V., Ford Motor Company, General Motors LLC, Robert Bosch GmbH, Robert Bosch LLC, VM North America, Inc., and VM Motori S.P.A.  The firm filed another suit in Florida on Nov. 2, 2018, against the same 10 defendants, again under the RICO statute, this time on behalf of more than 30 plaintiffs. We don't know how many other suits might have been filed, but the two suits mentioned apparently didn't have legs — the courts dismissed both quickly. So HMG shifted its strategy away from the RICO angle, and focused its efforts on GM, filing suit in California on Nov. 20, 2018. Instead of trying to catch 10 fish with a small net, HMG wants to score one fish with a big net. The results have borne more promise for the plaintiffs. In July this year, a judge in California denied GM's motion to dismiss, noting "the alleged defect is central to the vehicleÂ’s function." This latest suit filed on Aug. 6 in Detroit singles out GM again.  The Bosch CP4 is known to be problematic, however.

Ford GT, Buick Avenir and Audi Q7 take 2015 EyesOn Design awards

The annual EyesOn Design Awards at the Detroit Auto Show allows some of the greatest designers in the world to weigh in on the best production and concept debuts at the big event each year. For 2015, the large panel of judges included luminaries like Frank Stephenson of McLaren, Ralph Gilles from FCA and Moray Callum of Ford. Apparently the editors at Autoblog had a good eye because the winner of 2015's Best Designed Production Vehicle award went to the Ford GT, which was also our favorite debut from the show. The new supercar beat the Acura NSX and Mercedes-Benz GLE-Class Coupe for the honor. The judges described the Blue Oval's shape as "capturing the original GT40 in a modern interpretation," according to EyesOn Design. The Buick Avenir was also a big winner in the awards this year and received the nods for both Best Designed Concept Vehicle and Innovative Use of Color, Graphics and Materials. In the concept category, it beat out the Chevrolet Bolt and Mercedes-Benz F 015, and in the latter group, the sedan triumphed over Audi Q7, Mercedes F 015 and Volkswagen Cross Coupe GTE. The Q7 received its own accolade for Best Designed Interior, and it beat the Avenir and Infiniti Q60 for the honor. This year's Lifetime Design Achievement Award went to former Renault designer Patrick le Quement, and Bob Lutz received the EyesOn Design Catalyst Award for the second time. The honor is for an executive "who has empowered great design," according to the organization, which describes Lutz perfectly. Enterprise customer billed $47k for Mustang stolen from rental lot

A weekend rental of a Ford Mustang GT Convertible sounds like a nice, relaxing way to burn some gas, but one Nova Scotia woman's two-day rental is turning into a months-long headache. In early October, Kristen Cockerill picked up the Mustang from Enterprise Rent-A-Car, and she returned it the following day as stipulated by the rental contract. Unfortunately, she dropped the car off on a Sunday - a day on which the particular Enterprise office is closed - and the car ended up being stolen overnight.
Now, two months later, CBC reports that Cockerill received a bill from Enterprise for the full replacement of the car totaling $47,271 (a base 2014 Mustang GT Convertible currently costs $40,349 in Canada). As it turns out, the fine print in the contract says that the renter is responsible for cars dropped off after hours until it can be inspected the next business day - this is also reflected on the key drop seen in the news report video, which states "vehicles returned after hours are the responsibility of the renter until inspected on the next business day."
It's not clear how much, if any, of that amount Cockerhill will be responsible for once her insurance company gets involved, but if the insurance company refuses to pay, Enterprise will bill the amount to the credit card she provided during her rental. While this ordeal is far over for Cockerhill, it's a good reminder for the rest of us to always read the fine print.
