GM being sued over imploding Bosch fuel pumps in Duramax diesel trucks

Texas-based law firm Hilliard Martinez Gonzalez (HMG) this week filed a class-action lawsuit against General Motors over an alleged issue with Bosch CP4 fuel pumps. The suit claims Bosch designed the CP4 pump to work with European diesel fuel, which is thicker than U.S. diesel. When GM installed that pump in the 6.6-liter Duramax engine used from the 2011 to 2016 model years, the lawsuit claims the thinner U.S. fuel didn't provide enough lubrication, allowing air pockets to form in the fuel pump. That, in turn, allegedly let metal rub against metal inside the pump, causing the pump to eventually disintegrate and "send thousands of metal shards into the fuel injection system and every part of the engine." The Detroit News reported on the most recent lawsuit filed in Michigan's Eastern District Court, but the case is another piece of nationwide legal maneuvering going on since at least last September. Every U.S. truck maker used the Bosch CP4 fuel pump, and HMG originally went after all of them, as well as Bosch. On September 30, 2018, HMG filed a class-action suit in Texas on behalf of eight plaintiffs. The law firm wanted to prosecute the affair under RICO — the Racketeer Influenced and Corrupt Organizations Act — and named 10 defendants: FCA US LLC, FCA North America Holdings, LLC, F/K/A Chrysler Group, Fiat Chrysler Automobiles, N.V., Ford Motor Company, General Motors LLC, Robert Bosch GmbH, Robert Bosch LLC, VM North America, Inc., and VM Motori S.P.A.  The firm filed another suit in Florida on Nov. 2, 2018, against the same 10 defendants, again under the RICO statute, this time on behalf of more than 30 plaintiffs. We don't know how many other suits might have been filed, but the two suits mentioned apparently didn't have legs — the courts dismissed both quickly. So HMG shifted its strategy away from the RICO angle, and focused its efforts on GM, filing suit in California on Nov. 20, 2018. Instead of trying to catch 10 fish with a small net, HMG wants to score one fish with a big net. The results have borne more promise for the plaintiffs. In July this year, a judge in California denied GM's motion to dismiss, noting "the alleged defect is central to the vehicleÂ’s function." This latest suit filed on Aug. 6 in Detroit singles out GM again.  The Bosch CP4 is known to be problematic, however.

Mark Oberholtzer of Mark-1 Plumbing in Texas City, TX, has no need to imagine, but it's probably his worst nightmare. That's because an image of his old Ford F-250 is now on Twitter as a gun platform in the Syrian Civil War. While the image only appeared recently, Oberholtzer traded the truck in last November. Somehow since then the F-250 made its way from Texas to Syria. According to a report from television station WHOU, the dealer that took the trade said the pickup immediately went to auction. Unfortunately, along the whole route no one ever took Mark-1 Plumbing's name and phone number off the door. So when the image went up on Twitter, everyone knew whom the Ford previously belonged to. The plumbing company makes it abundantly clear that this whole bizarre situation is simply a coincidence, and it has absolutely no ties to the conflict in Syria. However, that isn't preventing people from phoning the business with angry calls and threats. Things are so bad that Oberholtzer keeps the phones unplugged for relief. Ford recalls 600,000 older-model sedans for braking issue

Ford is recalling 600,166 older-model Ford, Lincoln and Mercury vehicles over an issue that could affect braking and increase the risk of a crash. The safety recall covers certain Ford Fusion, Mercury Milan and Lincoln MKZ sedans from the 2006 through 2010 model years that were built at Ford’s Hermosillo Assembly Plant in Mexico between Feb. 22, 2006, and July 15, 2009. Ford says a valve that is normally closed inside the hydraulic control unit may get stuck in the open position or be slow to close, which could make it harder to engage the brakes and increase risk of a crash. Ford says itÂ’s aware of 15 reports of accidents and two injuries possibly related to the issue. Dealers will inspect the hydraulic control unit for signs of the problem and replace it, if necessary. The dealers will pressure-flush the system with brake fluid and replace the reservoir cap with a new one. Ford is also issuing a small recall of 33 of its 2020 F-150 trucks in the U.S. and 51 in Canada over potentially damaged spare tires. It says the bead area on the tires may have been damaged when it was mounted onto the wheel assembly, leaving it vulnerable to corrosion, separation of the bead wire and ultimately a rapid loss of air pressure and detachment from the wheel. Dealers will replace the spare tire. Affected vehicles were built at the Dearborn Truck Plant from Nov. 10-21 of this year.
