Appeals court rejects GM's bid to remove judge from Fiat Chrysler lawsuit

A U.S. appeals court on Monday denied General Motors' petition to remove a lower court judge from its racketeering lawsuit against Fiat Chrysler Automobiles, but said the companies' heads need not meet to settle the issue. The Sixth U.S. Circuit Court of Appeals said U.S. District Judge Paul Borman abused his discretion by requiring GM CEO Mary Barra and FCA's head, Mike Manley, to meet face-to-face for reasons unrelated to the case, and without taking into account the risks of travel during the COVID-19 pandemic. The district judge's order for the parties to report back to the court in only eight days was also unwarranted, the appeals court said. Borman in June ordered Barra and Manley to meet by July 1, and later amended his order to allow other officials in their place. "We do not mean to say, however, that the district judge may not order a pretrial settlement conference and/or mediation in the normal course," the appeals court said in a filing. The court in June stayed Borman's order requiring officials from the two firms to resolve the lawsuit, and on Monday rejected GM's request for a new judge to oversee the case, saying Borman's desire for a quick settlement was "not so extreme" that he needed to be replaced. GM said in a statement it was grateful that the court had quickly reviewed and granted its petition for a writ of mandamus, that is, setting aside the requirement to meet. However, the company did not comment on the rejection of its request to reassign the case to another judge. GM sued FCA last year, accusing the Italian-American company's executives of bribing United Auto Workers union officials to secure labor agreements that put GM at a disadvantage. Chrysler minivans under investigation for stalling after fuel refill

According to the National Highway Traffic Safety Administration, at least one man has reported that his 2007 Dodge Grand Caravan stalled unexpectedly on the highway shortly after being refueled. The unidentified man who contacted NHTSA regarding the issue cited as many as eight similar instances reported by other drivers.
NHTSA has announced that it will launch an inquiry into this issue, which could affect as many as 160,000 minivans from Dodge and Chrysler that were sold in 2007 (or more, if a problem is found that extends to additional models years, we'd assume). As of yet, there's no formal investigation, let alone a recall, on these vans, as the agency is merely determining if further action is needed.
Two months ago, Chrysler recalled nearly 700,000 vehicles, the majority of which were minivans, from the 2008-2010 model years to replace ignition switches after an investigation found that their weak springs and detent positions could fool a driver into thinking the car was in the "Run" position, when it's actually in the "Accessory" position.

Chrysler, Nissan minivans earn 'dire' crash test results, says IIHS [w/video]

First introduced in 2012, the Insurance Institute for Highway Safety's small-overlap frontal crash test has become the bane of many auto engineers' existence. It's a particularly steep design challenge because it forces just 25 percent of a vehicle's front end to take the brunt of a 40-mile-per-hour impact. The newly released results of four family-minded minivans underscore just how difficult the crash test is: only one scored an Acceptable rating, and the other three did very poorly. The 2008-2015 Chrysler Town & Country and Dodge Grand Caravan, plus the 2011-2015 Nissan Quest, all received Poor ratings in the test, the IIHS' lowest possible score. The three of them showed significant crash intrusion into the driver's area. The dummy in the Nissan actually had to be cut out of the vehicle, with an IIHS spokesperson remarking, "the structure collapsed like a house of cards." In the Fiat Chrysler Automobile vans, the steering wheels moved out of the way, making the airbag less effective and letting the driver's head hit the dashboard. While it was not actually crashed, the agency is also giving the 2009-12 Volkswagen Routan a Poor score because it shares a structure with the FCA models. The newly released results of four minivans underscore just how difficult the small-offset crash test is. The refreshed 2015 Toyota Sienna (shown), conversely, earned an Acceptable rating and is also a Top Safety Pick+ because of its optional forward collision warning and automatic braking system. While the crash test dummy moved around during the impact more than the agency would have liked, sensors showed a low risk of injuries. The IIHS tested the Honda Odyssey last year, and it earned a Good overall score, the agency's best ranking. It's also a Top Safety Pick+ vehicle. The only member of the minivan segment left to test is the latest Kia Sedona, and the Institute is reportedly waiting a little longer for Kia to make changes to improve the model's performance. When reached for comment, Nissan spokesperson Steve Yaeger provided Autoblog with the following statement: "Nissan is committed to vehicle safety and believes that consumers should have information about crash protection so they can make educated buying decisions. Nissan is proud of the 2014 Quest's "good" rating in the IIHS front moderate overlap and side impact tests as well as a "good" head restraint rating.
