Appeals court rejects GM's bid to remove judge from Fiat Chrysler lawsuit

A U.S. appeals court on Monday denied General Motors' petition to remove a lower court judge from its racketeering lawsuit against Fiat Chrysler Automobiles, but said the companies' heads need not meet to settle the issue. The Sixth U.S. Circuit Court of Appeals said U.S. District Judge Paul Borman abused his discretion by requiring GM CEO Mary Barra and FCA's head, Mike Manley, to meet face-to-face for reasons unrelated to the case, and without taking into account the risks of travel during the COVID-19 pandemic. The district judge's order for the parties to report back to the court in only eight days was also unwarranted, the appeals court said. Borman in June ordered Barra and Manley to meet by July 1, and later amended his order to allow other officials in their place. "We do not mean to say, however, that the district judge may not order a pretrial settlement conference and/or mediation in the normal course," the appeals court said in a filing. The court in June stayed Borman's order requiring officials from the two firms to resolve the lawsuit, and on Monday rejected GM's request for a new judge to oversee the case, saying Borman's desire for a quick settlement was "not so extreme" that he needed to be replaced. GM said in a statement it was grateful that the court had quickly reviewed and granted its petition for a writ of mandamus, that is, setting aside the requirement to meet. However, the company did not comment on the rejection of its request to reassign the case to another judge. GM sued FCA last year, accusing the Italian-American company's executives of bribing United Auto Workers union officials to secure labor agreements that put GM at a disadvantage. The 2021 Chrysler Pacifica offers something no other minivan can match: a plug-in hybrid model that can go 32 miles on electricity alone and therefore slash your annual fuel bill. It also costs less than the regular V6 version (and Toyota's traditional, non-plugged-in hybrid Sienna) when you factor in federal and state tax credits, and we even like driving it more. In other words, the Pacifica Hybrid is the one to get. But is that novel powertrain enough to make the Pacifica a better choice than the scarce number of other vans for your? Well, considering that the V6-powered version can hold its own against the Honda Odyssey, Toyota Sienna and Kia Sedona/Carnival (literally the only other options), it's a distinct possibility. The Pacifica Hybrid is basically tied with the Sienna has our top choice in the segment in our comparison test, but with so few other rivals, we still recommend checking out the full field. It's also worth noting that Honda, Toyota and Kia have stronger reliability ratings than Chrysler, while the Hybrid's higher monthly payments may not fit your budget despite the hefty one-time tax refund. The Pacifica gets its first comprehensive set of upgrades since being relaunched as a minivan back in '17. The front end has been restyled and LED lighting applied as standard front and rear (the budget-oriented Chrysler Voyager maintains the Pacifica's old look). The Pacifica also now matches its rivals by including a full suite of driver assistance and safety technologies as standard equipment. Infotainment technologies have also been upgraded: Chrysler's latest UConnect interface is paired with a standard 10.1-inch touchscreen; standard Apple CarPlay and Android Auto have been upgraded to wireless connectivity, and Amazon Alexa has been added. New available equipment includes USB-C ports, wireless smartphone charging, the FamCAM rear interior camera, and new games for the rear seat entertainment system. Also new for 2021 is the option of all-wheel drive and the range-topping Pinnacle trim level. The Pacifica Hybrid has also been changed to a powertrain option for the Touring, Touring L, Limited and Pinnacle trim levels – it was technically a separate model before. This is simpler. The Chrysler Pacifica Hybrid is a compelling minivan, which feels less weird to say the more we say it (and the more we drive it). Adding a plug-in powertrain to an already solid family hauler makes it more interesting, and leaves the world just a little less greenhouse-gassy for those children you'll be carrying around in it. So, when we had the chance to actually take one home with us, we strapped in the car seat and put it through some real-world usage. For reference, the non-hybrid Pacifica comes with the standard Pentastar 3.6-liter V6, connected to a nine-speed automatic transmission. It provides 287 horsepower and offers 19 miles per gallon city, 28 highway, and 22 combined. The Pacifica Hybrid adds two electric motors and a variable transmission to its more efficient, less powerful Atkinson cycle V6, providing a total of 260 horsepower. The Hybrid also has a 16-kWh battery pack to power its electric driving. It's rated at a combined 84 miles-per-gallon equivalent. Our test kid, Wolfgang, loved the Pacifica Hybrid. He repeatedly asked for rides, which is not unusual, but seemed to prefer the Chrysler to his other options. He even got upset the one time we put him in Mama's Mercedes GLK while the Pacifica was in the driveway. Wolfgang especially loved the buttons to open and close the automatic doors. After heading indoors, he'd occasionally point out the window toward the minivan saying, "Button." He also thought the horn was hilarious. He's heard his fair share of car horns so far in his young life, but none have ever gotten the same belly laughs that the horn in the Pacifica evoked. We have no idea why. Getting the car seat in and out of the Pacifica Hybrid was super easy. The captain's chairs make it even easier. The LATCH anchors were prominent, and easy to find by feel when reaching over the seat. It also helps that you can access the inside anchor by hopping to the other side of the vehicle, and the openness of the second row provides more room to work with. Once in the car, the huge door openings made it easy to get the little guy in and out of the rear-facing seat.
