Appeals court rejects GM's bid to remove judge from Fiat Chrysler lawsuit

A U.S. appeals court on Monday denied General Motors' petition to remove a lower court judge from its racketeering lawsuit against Fiat Chrysler Automobiles, but said the companies' heads need not meet to settle the issue. The Sixth U.S. Circuit Court of Appeals said U.S. District Judge Paul Borman abused his discretion by requiring GM CEO Mary Barra and FCA's head, Mike Manley, to meet face-to-face for reasons unrelated to the case, and without taking into account the risks of travel during the COVID-19 pandemic. The district judge's order for the parties to report back to the court in only eight days was also unwarranted, the appeals court said. Borman in June ordered Barra and Manley to meet by July 1, and later amended his order to allow other officials in their place. "We do not mean to say, however, that the district judge may not order a pretrial settlement conference and/or mediation in the normal course," the appeals court said in a filing. The court in June stayed Borman's order requiring officials from the two firms to resolve the lawsuit, and on Monday rejected GM's request for a new judge to oversee the case, saying Borman's desire for a quick settlement was "not so extreme" that he needed to be replaced. GM said in a statement it was grateful that the court had quickly reviewed and granted its petition for a writ of mandamus, that is, setting aside the requirement to meet. However, the company did not comment on the rejection of its request to reassign the case to another judge. GM sued FCA last year, accusing the Italian-American company's executives of bribing United Auto Workers union officials to secure labor agreements that put GM at a disadvantage. NHTSA investigates a million-plus Jeep Cherokees for parking brake issue

The National Highway Transportation Safety Administration (NHTSA) is investigating a potential safety issue that could be present in more than 1 million Jeep Cherokees sold for the 2014-2020 model years. Per owner complaints, these cars may be equipped with an electronic parking brake control module that is susceptible to water intrusion. If the water causes a short, it can result in uncommanded activation of the parking brake while the vehicle is in motion, which can lead to a stall, NHTSA says.  If you follow Jeep Cherokee news closely (and who doesn't?), this issue may ring a bell. That's because Jeep was on the hook for recalling the Cherokee for water intrusion into the liftgate control module, which is fitted right next to the parking brake module. In that instance, short circuits had the potential to cause a fire, which has not so far been indicated as a potential side effect of the new parking brake issue, but any time electricity is involved, there's usually at least some risk for ignition.  The Cherokee is just one of four Stellantis models with a new open investigation, the Detroit Free Press reported Tuesday. NHTSA is also looking into reports of a transmission problem that could strand owners of 2019-2021 Chrysler Pacifica plug-in hybrid minivans and a crankshaft and/or camshaft position sensor problem that could cause a stall in the 2016 Dodge Journey and Jeep Compass. Between the two, these investigations cover an additional 300,000 vehicles.  None of these vehicles are being recalled at this point, however a NHTSA investigation is the first major step toward a recall being initiated. Chrysler nets $1.6B income in Q4, Fiat profit up 5%

Chrysler announced its 2013 financial results today and unveiled its new name and decidedly bank-like logo. Amid the announcement, Chrysler posted big gains in income, while Fiat didn't perform to analysts' expectations.
For 2013, Chrysler had revenue of $72.1 billion, up 10 percent from 2012. Net income reached $2.8 billion, a 65-percent increase. It was the company's third straight year of annual profits.
In terms of unit sales, Chrysler sold 2.4 million cars worldwide in 2013, up 9 percent. According to Automotive News, 1.8 million of those vehicles were sold in the US, a 14-percent increase. The sales growth boosted Chrysler's US market share to 11.4 percent, up 0.2 percent.
