Former Chrysler dealers could reopen under appeals court ruling

Years after the bankruptcies and subsequent bailouts of Chrysler (now FCA) and General Motors, the automotive industry is still seeing legal decisions about them come through the courts. The latest ruling from a US appeals court has given 4 of the 789 dealers that Chrysler closed in its Chapter 11 process one less hurdle towards reopening. Following the bankruptcy, 105 of the shuttered dealers went through an arbitration process in hopes of reopening, and 32 won their arguments. However, a victory in that undertaking didn't necessarily mean that the stores could reestablish themselves. For these three showrooms in Michigan and one in Las Vegas, state laws allowed nearby competitors from the same automaker to stand in the way of restarting, according to Automotive News. This problem brought yet another lawsuit, and a US district court found that the arbitration decisions did not overrule state laws. The latest appeals court ruling overturned that decision. However, as with many legal proceedings, the process for reopening for these dealers still isn't exactly easy. The latest decision only covers the nearby dealers' ability to protest; it doesn't mandate FCA actually to open the stores again. According to a statement from Michael Palese of FCA legal communications to Automotive News, the ruling, "did not provide for reinstatement of the dealers who prevailed in arbitration, but only gave them a right to a 'customary and usual' letter of intent." It means for these showrooms to start selling again, now they need to work things out with Chrysler's new owner.

EIB ups financing for Fiat Chrysler's electric vehicles to $949 million

MILAN — The European Investment Bank (EIB) has increased to almost 800 million euros ($949 million) its funding to Fiat Chrysler Automobiles (FCA) to support production of electric and hybrid vehicles, they said in a joint statement. Investments to manufacture battery electric vehicles and plug-in hybrid electric vehicles will be mainly directed at FCA plants located in southern Italy, supporting employment and compliance with the strictest environmental criteria. To improve capacity utilization at FCA's Italian plants, the group has announced a 5 billion euro investment plan for the country through 2021 which envisages the launch of new electric and hybrid models. EIB and FCA had sealed 300 million euros in financing before the summer to fund investments for plug-in hybrid electric vehicle production lines at plants in Melfi, in the southern Basilicata region, and battery electric vehicles at Fiat's historic Turin plant of Mirafiori over the 2019-2021 period. FCA has now finalized a 485 million euro deal with EIB to support both an innovative line of plug-in hybrid electric vehicles at the Pomigliano plant in the southern Campania region as well as R&D activities at FCA laboratories in Turin. 2018 Honda Odyssey bests Pacifica, Sienna in minivan crash, LATCH tests

Honda has a lot to be proud of following the latest round of passenger small-overlap crash testing by the IIHS. The safety organization tested the 2018 Honda Odyssey, 2018 Chrysler Pacifica and 2018 Toyota Sienna, and the Odyssey managed the best rating of "Good." The Pacifica followed behind with an "Acceptable" rating, and the Sienna brought up the rear with just a "Marginal." Both the Pacifica and Sienna lost points because the structure around the passengers collapsed to differing extents, leading to parts of the structure intruding into the passenger compartment. The Pacifica didn't intrude enough to harm passengers, with each injury area still having a Good rating, but the Sienna's structure intruded far enough to potentially harm the leg and foot areas, leading to an Acceptable rating in those specific areas. In addition to the small overlap crash test, the IIHS evaluated all three minivans for LATCH child seat anchor ease of use. Once again, the Odyssey aced the test with a Good+ rating, which is awarded for both ease of use and offering multiple anchor point options. The Pacifica and Sienna swap the crash test ratings, with a Marginal for the Chrysler and an Acceptable for the Sienna. The Odyssey and Pacifica can both brag that they're Top Safety Picks, and they'd get Top Safety Pick+ awards if they weren't hampered by headlights that only get Acceptable ratings. The Toyota Sienna fails to earn the regular Top Safety Pick award because both small overlap tests yielded results that were too low. Only one other minivan tested by IIHS has the Top Safety Pick rating, and that's the Kia Sedona. It earns an Acceptable rating in LATCH usability, and its headlights actually earned a Good rating. It hasn't undergone passenger-side small overlap crash testing yet. If it fares well, it could get bumped up to a Top Safety Pick+ rating.
