Federal judge throws out GM's racketeering lawsuit against Fiat Chrysler

  DETROIT — A federal judge on Wednesday threw out a racketeering lawsuit General Motors had filed against smaller rival Fiat Chrysler Automobiles, saying the No. 1 U.S. automaker's alleged injuries were not caused by FCA's alleged violations. GM officials said in statement they "strongly disagree" with the order by U.S. District Court Judge Paul Borman, whom the automaker had sought to have removed from the case, and would appeal. "There is more than enough evidence from the guilty pleas of former FCA executives to conclude that the company engaged in racketeering, our complaint was timely and showed in detail how their multi-million dollar bribes caused direct harm to GM," GM said in a statement. The Detroit company added that Borman's decision "would let wrongdoers off the hook." GM filed the racketeering lawsuit against FCA last November, alleging its rival bribed United Auto Workers (UAW) union officials over many years to corrupt the bargaining process and gain advantages, costing GM billions of dollars. GM was seeking "substantial damages" that one analyst said could have totaled at least $6 billion. FCA had called the case meritless and asked Borman to dismiss it. On Wednesday, Borman dismissed the lawsuit "with prejudice," meaning GM cannot refile the complaint. "The direct victims of defendants' alleged bribery scheme are FCA's workers," Borman wrote of FCA. "GM's high labor costs were not an injury proximately caused by FCA's bribes, and any competitive injury that GM suffered as a result of FCA's advantage in labor costs is an indirect injury." "The dismissal of GM's complaint with prejudice earlier today vindicates our position," FCA said in a statement. On Monday, the Sixth U.S. Circuit Court of Appeals denied GM's petition to remove Borman from the case, but said the two automakers' chief executives didn't have to meet to try to settle the case as Borman had ordered. Dodge recalling 2k SRT Hellcat Challengers and Chargers for fuel leak

Bad news for fans of the obscene output of the Dodge Hellcat twins, as FCA has announced a voluntary recall of both 707-horsepower variants of the 2015-model-year Charger sedan and Challenger coupe. According to FCA, a total of 2,211 cars are being recalled after a dealer discovered a "possible fuel leak" during a pre-delivery inspection. Despite getting cleared by suppliers, FCA claims its engineers found "improperly installed" hose seals. Owners of affected vehicles will receive notification and be asked to report in for repairs. Of the vehicles affected, the overwhelming majority, 2,012, were sold in the US market. The remainder were sold in Canada (148), Mexico (30) and just 21 outside of North America. An FCA US dealer alerted the Company to a possible fuel leak following a pre-delivery vehicle inspection. These components had passed the supplier's leak-testing, but FCA US engineers launched an investigation and discovered certain hose seals may have been improperly installed. The Company is unaware of any related injuries, accidents or customer complaints. Affected are model-year 2015 Dodge Challenger SRT coupes and Dodge Charger SRT sedans equipped with 6.2-liter V-8 engines. Poor Chrysler 200 sales blamed for 1,420 layoffs in Sterling Heights

FCA will indefinitely lay off a total of 1,420 workers from its Sterling Heights Assembly and Stamping plants on July 5, according to The Detroit News. This decision will cut a 1,300-person shift that builds the Chrysler 200, and it will also affect 120 people who stamp the sedan's components. The company's statement said the decision would "better align production with demand." FCA plans to give these folks open full-time positions as they become available. Chrysler 200 sales are down 63 percent to just under 18,000 units so far in 2016. After the cuts, there will still be one shift to build the 200, but even then the model won't have much of a future. In January, CEO Sergio Marchionne announced that FCA would discontinue production of the 200 and Dodge Dart because customers were no longer interested in small sedans. All of the roughly 3,000 hourly workers at Sterling Heights have been on a temporary layoff since February 1, according to The Detroit News. They don't go back to work until next week. United Auto Workers Vice President Norwood Jewell released a statement saying that while the "shift reduction at Sterling Heights Assembly is unfortunate, it is not unexpected." However, he was fairly upbeat about the cuts because FCA plans to increase production capacity for trucks and SUVs. "I believe that in the long term this move will be a positive one for our members and the company," he said. During last year's labor negotiations, the UAW's deal reportedly included an agreement for FCA to move 200 and Dodge Dart production to Toluca, Mexico, but the company promised to build the Ram 1500 at Sterling Heights Assembly. FCA spokesperson Jodi Tinson gave no comment about future vehicles at the factory when asked by Autoblog. The Company will place indefinitely laid off employees in open full-time positions as they become available within the Detroit labor market based on seniority.
