Chevy Volt, Nissan Leaf sales show big drops in September

As most readers likely know, it's not just lower gas prices that are affecting plug-in vehicle sales. The two long-time sales leaders in the US - the Nissan Leaf and the Chevy Volt - are getting long in the tooth. First introduced in late 2010, the vehicles have been updated here and there since then, but recent sales figures have been lagging behind where they were in 2014. This trend continued in September, with sales of both vehicles down in a big way compared to last year. Sales of Nissan Leaf totaled 1,247 for the month of September. This is down a whopping 56.7 percent from September 2014, but thankfully the year-to-date sales are not quite as negative. So far this year, Nissan has sold 13,630 Leafs, which is "just" 37.5 percent lower tan the YTD total at this point in 2014 (21,822). This decrease swims against the overall direction of Nissan's September sales, which were up 18 percent over last year and set a new September record. The Volt sold 949 units last month, down 31.9 percent from last September. Year to date, the Volt has sold 9,264 units, which is 36.3 percent lower than the number of Volts that were sold in the first nine months of 2014 (14,540). This downward trend might be coming to an end soon. The new Chevy Volt will go on sale in 11 US states later this fall, and the 2017 model will be available nationwide next spring. An updated Leaf for the 2016 model year also offers more miles – 107, vs 84 in the 2015 version – so potential customers who have been waiting for the latest and greatest will soon not have any excuses. GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. The VW diesel emissions scandal, first brought to light in September, gets a new wrinkle, as an internal investigation by the German automaker revealed [00:00:30] irregularities in CO2 emissions that could affect approximately 800,000 vehicles. VW estimates the issue could pose a 2-billion euro economic risk. VW claims that most of the vehicles affected have diesel engines, but industry analysts say a 1.4-liter gas engine is also affected. VW says that fuel consumption figures were set too low during the CO2 certification process. During all of this, sales of some diesel-powered Volkswagen, Audi, and Porsche models [00:01:00] have been halted. Takata Corporation is back in the news in connection with its deadly airbag scandal. Federal regulators fined Takata $70 million. If the parts supplier does not comply, the fine could balloon to $200 million. Takata was also dropped this week by its biggest customer, Honda. And now, Toyota and Mazda will be following Honda's lead in dropping Takata. We're also hearing that Mitsubishi and Subaru are considering a switch in air-bag inflator suppliers. SEMA 2015 [00:01:30] came and went. We saw offerings from Mopar, like the AWD Challenger concept. Honda unveiled a Ridgeline that it will race at the Baja 1000, which gives us a hint at what future production model could look like. The celebrity presence was also felt in Vegas as it always is. Kid Rock brought a Duramax Diesel Chevy Silverado, and Acura restored and presented Ludacris with his now famous 1993 Acura Legend. Those are the highlights from the week that was.
