GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Chevy Bolt-based prototype may be a Buick EV for China

Late last spring, we got a look at a GM prototype that was clearly based on the Chevy Bolt EV, but with updated styling. It seemed like it could be a more crossover-styled Bolt, given the recently trademarked name of EUV. Now we get another look at the prototype, but the bodywork seems less suggestive of a Chevy, and more of a Buick. This vehicle definitely still appears to be based on the Bolt, rather than on another small GM platform. In the photos of it next to the current model, the size, wheelbase and profile are extremely similar. There are differences, though. The nose isn't as sloped or as rounded, and the rear window kicks up a little earlier. The biggest changes are in the front and rear fascias, and it's here that we see hints of Buick. There are prominent air inlets on each side of the front bumper that give the car a more aggressive look. The headlights still have a fairly rounded, organic look, but with little extensions like fangs underneath. The styled running-light section, rounded shape and the smoked lenses seem very Buick-like. The grille features a large badge that doesn't fit the shape of a bow-tie, and is more that of a round logo like Buick's. Around at the back, the full-width taillights stand out, and in the middle there is obviously a round badge, again like a Buick. The wide taillights would also be a natural evolution of Buick's current light design language that uses somewhat wide and thin lights. The rear bumper has been redesigned with new lower taillights. Now that we've established that this seems very much like a Buick, we don't think we'll see this particular version offered here with the badge. This is more likely a Buick version of the Bolt for the Chinese market, where the brand is associated with luxury and has been the spearhead for GM's electric and hybrid models. In fact, the Chevy Volt hybrid was sold there as the Buick Velite 5, which was part of a family of a electrified Velite models. This would probably also carry a Velite badge as well. While we might not see this specific Buick variant, we probably will see it offered as a Chevy in some form. With its more aggressive, crossover shape, it could be the rumored EUV model. Or it could be just a refresh of the current Bolt, since the model has been largely unchanged since its introduction for the 2017 model year. And extrapolating from this prototype, we can see how the headlights could be tweaked to tie into those air scoops as on the Suburban and Silverado.

Watch a 2015 Corvette Z06 run the quarter in 11.7 seconds

We're not writing about this because it's an amazing run, we're writing about it because it appears to be the first run. Someone took a 2015 Corvette Z06 to Royal Purple Raceway in Baytown, Texas and blasted it down through the quarter mile. It's still wearing the dealer number in wax pen on the windshield and dealer plates, so this example is fresh from the mold. It's also a seven-speed manual. General Motors said the row-your-own Z06 can do the 'strip in 11.2 seconds, and they undoubtedly had a professional driver and more than one run to set that time. To have Just Some Guy show up at the raceway and do an 11.7 at 120.54 mph on his first run means we expect good things to come as Z06s get delivered to their owners. Check out the run in the video.
