GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Chevy Colorado gets box delete option designed for upfitters

The Colorado, which marks the return of Chevrolet to the midsize truck segment, is receiving critical praise, and now it's time for the pickup to get to work. At the National Truck Equipment Association Work Truck Show in Indianapolis, IN, Chevy is unveiling a box delete option package for the model that allows businesses to custom tailor the Colorado to their needs. The choice to remove the bed is exclusively available on the Colorado Work Truck trim in the rear-wheel drive, extended cab model with a 305-horsepower, 3.6-liter V6 and six-speed automatic gearbox, and Chevy claims this is the only option of its type in the segment. Beyond the obvious loss of the rear, these trucks feature eight mounting points on the frame for upfitters to install any necessary modifications. They also get the Z82 trailering package and a locking differential. The versions with the box delete package carry a payload rating of 2,200 pounds an a gross vehicle weight rating of 6,001 pounds. "It's ideal for utility companies requiring service bodies, as well as landscapers and other businesses needing the utility of a flatbed," Ed Peper, US Vice President for General Motors Fleet and Commerical, said in the option's announcement. Further options with the package are limited to choosing a repositioned fuel filler for the upfitter to install and deleting the rear seat for extra interior capacity. The box delete becomes available in mid-April, and buyers get a $300 credit off the price of the Colorado when it's selected. My daily life revolves around used cars. As a former fast-talking auto auctioneer, it was once my job to inspect, appraise, and liquidate thousands of cars throughout the United States. Since I put down my microphone and became a full-time car dealer, I have gone from auctioning off 150 vehicles an hour – yes, we really do talk that fast – to buying 150 vehicles every two to three months. I see and bid on everything from $300 Volkswagens that belch more black smoke than a diesel truck rolling coal, to $30,000 DeLoreans that hopefully can go at least 88 miles per hour. The auctions never run out of weirdness when it comes to cars because they sell over 10 million every single year. So with that big number in mind, let me tell you about these two cars that have about as much in common as Mel Gibson and Mel Brooks.Option A: 1993 Chevrolet Camaro Indy 500 Pace Car Edition View 24 Photos This 1993 Chevrolet Camaro Indy Pace Car has all of 4,187 miles on it. Neither of those numbers are a misprint and yes, those are multi-colored stripes on the hood. Every week, I find at least two or three museum pieces that have been stored in the private garage of an auto collector. He had a brief time in prison in between the before and the surprise after and trust me, he looked like he had soiled his britches when he saw what happened to his personally prized Cutlasses. Then you have whoever owned this Camaro. Is it a one-of-a-kind? Nope. Just 1 of 125, and an insignificant number at that (#87). But let's open the door to this Camaro and see what we find. Oof! I don't remember this multi-colored silly string design as a '90s must-have. Wasn't this popular back in the 1980s?
