GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. 24 Hours of Le Mans live update part three

We tasked surfing journalist Rory Parker to watch this year's live stream of the 2016 24 Hours of Le Mans. What follows is an experiment to experience the world's greatest endurance race from the perspective of a motorsports novice. Parker lives in Hawaii and has an associates degree in dropping f-bombs. For Part One, click here. Part Two is here. Really hoped I'd be able to grab an hour or two of sleep before the sun rose over Le Mans. Dark dark dark, couldn't figure out what was going on. Commentators struggled at times as well. But I couldn't do it. Endurance racing is just too exciting. Grabs my attention with both fists. Screams, "watch these men DRIVE!" A neighbor invited me over for drinks. Told him, "Can't do it, gotta watch Le Mans!" Maybe not exactly. I'll admit, at times my attention wandered. I did a load of laundry. Ate some snacks. Half listened to the commentary. Threw a hump at my wife. I learned that Patrick Long, driving #88, is big brother to Kevin "Spanky" Long. Spanky's a bit of a legend in the skate world. Always weird how top notch talent can run in families like that. Kind of surprised I've never heard that before. Worked for a skate mag for a years, met Spanky a handful of times. Someone must've told me that he has an older brother who drives race cars. Dash cams at night are scary. High powered headlights in the P1s reach almost 300 meters. Cars outrun that distance easy. Seems like they're just steering into the black and hoping for the best. But that can't be the case. People'd be dropping dead let and right. Very amused by how the guys in GT are like, "Dude, stop flashing your fucking lights before you pass." But the LMP's are all, "Suck a dick! I do what I want." Top three stayed neck and neck nearly all night long. As the sun gets ready to creep back over the horizon the top three are separated by only eleven and a half seconds. Toyota 5 and 6, Porsche 2. Audi 8 is two laps behind Porsche, beleaguered 7 is dealing with constant trouble eleven laps from the front. GTE Pro sees Ferrari 82 in first, Ford 68 and 69 right behind. To win you've gotta drive perfect, build perfect. Fours cars retired so far. I'm beginning to appreciate the endurance aspect a little more fully. Only really considered the drivers at first. The mental and physical stress driving these cars at these speeds at length would inflict. But keeping the damn things running is the real deal. To win you've gotta drive perfect, build perfect.

"Turbo" Chevrolet Camaro is a 700-HP fantasy car come to life [w/video]

For a concept car built to promote an animated movie about a snail that wants to go racing, this thing ain't half bad. The outsized monster you see before you started life as a Chevrolet Camaro ZL1, and then went through a big-time Hollywood makeover before being positioned on the Chevrolet stand here in Chicago.
This 2013 "Turbo" Camaro Coupe is getting the promotion machine ratcheted up for a new DreamWorks tale by the name of, you guessed it, Turbo. Coming this summer, the movie will follow one snail's quest to become a race driver worthy of making the cut at the Indy 500. Like many DreamWorks vehicles before it, we're guessing that the petrolhead snail will star in a movie that adults (especially racing fans) with have no trouble watching with their kids. As for the car, we're told that it is "instrumental" in transforming Turbo from snail into racer. Helping the beastly pony car in this mighty task, is an ankle-cracking front splitter matched by a ungodly huge rear wing out back, a COPO hood and a supercharged (yes, supercharged) V8 engine making more than 700 horsepower. 24-inch wheels all the way around - 10-inches wide in front and 15-inches wide in back - should allow the "Turbo" Camaro to hook up with ease, as well.
