GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Chevy reveals Colorado Z71 Trail Boss Edition

Chevrolet wants to make sure that if people are in the market for a midsize pickup, then there is a Colorado available to fit their desires. For businesses, there's the recently unveiled box delete package and for those looking for a customized look, there's the GearOn Edition. For the latest Z71 Trail Boss version, the automaker is going for folks planning to go off-road. As the name suggests, all Trail Boss versions of the Colorado start with the already off-road-inlined Z71 trim level, including its 305-horsepower, 3.6-liter V6 and six-speed automatic, and the package can be added to practically any body variant: extended or crew cab, long or short bed and rear- or four-wheel drive. To set things apart, there's a locking rear differential, front tow hooks, darkened 17-inch wheels that are shod with Goodyear Wrangler DuraTrac tires and on the four-wheel drive models, a transfer case shield. For some extra style, the Colorado Trail Boss wears black parts for the fender flares, side steps and Bowtie badges. The bed also gets a spray-on liner and a few parts from the GearOn accessory catalog, including the tie-down rings, load bar and cargo divider. The Trail Boss goes on sale in the spring, and to add all of this equipment to a Colorado, it costs $3,320 in addition to the price of any Z71 trim model. GM takes heat for aborted Silverado riff on 'Boston Strong' at World Series

During game five of the World Series, Chevrolet was set to do a spot of marketing for the 2014 Silverado - fans at Busch Stadium in St. Louis would hold up placards that spelled out the words "Silverado Strong," a theme that Chevy has been promoting since the Silverado's launch with the song "Strong," by Will Hoge. The St. Louis promo was ultimately called off, though, over concerns that it'd be insensitive to the visiting Boston Red Sox. Now, the Busch Stadium stunt might not have been a big deal, had the St. Louis Cardinals not been playing the Boston Red Sox. Following the tragic events in Boston during the marathon back in April, the phrase "Boston Strong" gained traction among the city's citizens, especially at sporting events. So, you can imagine that Chevy's appropriation of the phrase might not sit well with some fans.
The stunt was ultimately shelved after images of the signs went viral before the game, leading to a bit of a public backlash. Chevy spokesperson Michael Albano said of the promo that it was meant to show the brand's "commitment to baseball and its fans." But after the images went viral, the company "realized there was the possibility that we may offend some of the very fans we were trying to honor," Albano told Automotive News via email.
