GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Two high-powered, high-priced sports cars, wrecked in their infancies. No doubt they were fun while they lasted. In Great Falls, Va., a tony suburb of Washington, D.C., that hugs the Potomac River, someone was out enjoying driving the McLaren 720S they had purchased only the day before on a leafy, two-lane road. Then, horror: In an instant, the car hit a tree, mangled and destroyed "because of speed," according to the Fairfax County Police Department. Purchased Friday. Totaled Saturday. It had just 15 miles on the odometer. We know nothing of the backstory, except for the obvious front-end damage and secondary damage to the undercarriage. The rear end and 6.2-liter V8 engine, which makes 460 horsepower and 465 pound-feet of torque, look OK. The most current bid as this was published was just north of $9,000. It's tempting in both cases to assign the blame to over-eager drivers who weren't quite yet able to corral all that power. In the case of the McLaren, the supercar makes 710 horsepower and 568 pound-feet of torque from its quad-cam, twin-turbo 4.0-liter V8. It goes from 0-62 miles per hour in 2.9 seconds and boasts a top speed of 212 mph. We're not saying the unidentified driver was a newbie, but this car is definitely not for newbies. eBay Find of the Day: Mario Andretti's personal 2009 Corvette ZR1

With victory in the the Indianapolis 500, a Formula 1 World Championship, a win in the Daytona 500 and too many other motorsports accomplishments to list, Mario Andretti stands among not just the greatest American racing drivers of all time, but the greatest drivers, full stop. Apparently, the champ is also a fan of speed when not on the track, because now there's a chance to own what is said tobe his personal 2009 Chevrolet Corvette ZR1 with just 12,872 miles on the clock. The eBay Motors auction page clearly shows Mario Andretti standing with the car, but the rest of the ad is admittedly short on details. The vehicle history report lists only one previous owner – ostensibly Andretti. The exterior is a handsome Blade Silver Metallic accompanied by a Dark Titanium leather interior. However, the seller keeps additional information to a minimum as well with the description simply stating, "This 2009 Chevy Corvette ZR1 is owned by Mario Andretti and has been garage kept all its life. It is fully loaded with all option on this car." The future buyer will get a seriously great car along with some huge bragging rights at any party by touting its ownership history. We've reached out to the seller for more particulars and provenance, and will update this story if we hear back. In the meantime, the auction for this C6 ends on Thursday, January 8, and currently the reserve isn't met. The price sits at a hefty $68,100 as of this writing, with six bids registered.
