GM does not have to turn over its ignition switch documents

In June the lawyer representing plaintiffs suing General Motors over faulty ignition switches accused GM and its firm King & Spalding of working together to cover up the malfunction. Bob Hilliard said that certain communication between GM and King & Spalding from 2010 to 2013, mainly focused on three Chevrolet Cobalt crashes, would reveal that they conspired in "burying what they knew" concerning the defect, and furthermore that the law firm broke rules of professional conduct once it found out about "ongoing fraudulent concealment" at GM. Hilliard filed a motion in a Manhattan court to force GM and King to hand over the memos, which were protected by attorney-client privilege. Hilliard said that the alleged ongoing fraud should trump attorney-client privilege, a GM spokesman said at the time that the issues in question had already been discussed previously, and that plantiffs already had much of the communication Hilliard's motion sought. US District Judge Jesse Furman ruled in favor of GM and King, refusing to order the release of the communication. In spite of finding probable cause that GM was engaging in a crime or fraud by not revealing the ignition switch defect, Furman did not find cause to believe that GM and King's discussions at the time were centered around continuing that potential crime or fraud. Saying also that plantiffs already had many of the disputed documents, attorney-client privilege should hold sway over the remainder. The class action case goes to trial in January 2016.

China's rise, global restructuring wither GM's Korea division

An article in the Daily Kanban suggests the sun is setting on GM Korea, and it could already be well into dusk. GM Korea came about when General Motors, along with co-investors SAIC and Suzuki, bought Daewoo Motors from parent company Daewoo Group in 2001; it had a previous tie-up with GM, a joint venture that ended in 1992, although Daewoo cars were based on GM cars until 1996. Over the decade following the purchase, it became such an important part of operations that it was renamed GM Korea in 2011, "to reflect its heightened status in [the] global operations of GM." Just two years later, the printed rumors were that the subsidiary responsible for a fifth of Chevrolet's global production could be shutting down. The division's sales were down almost 21 percent through November of last year, counting domestic South Korean sales, exports, and CKD – Complete Knock Down – products. That makes the labor strife, already an issue for four years, even more acute, reports say the subsidiary will lose $36 million a year if it can't get the job and wage cuts it wants, and government concessions can't make up for the losses. 2021 Cadillac Escalade, GMC Yukon, Chevy Suburban/Tahoe recalled for stall risk

General Motors is recalling just shy of 15,000 2021 Cadillac Escalade & Escalade ESVs, Chevrolet Suburbans and Tahoes, GMC Yukons and Yukon XLs that were shipped with fuel pumps that were built with a batch of what may be faulty electronic control modules. A pump with a bad module can result in intermittent function, resulting in drivability issues and potential stalls. No serious incidents or injuries have been associated with the issue.  GM says it discovered the issue after analyzing early recall data for the 2021 model SUVs and discovering an unusually high failure rate for fuel pumps manufactured by a single supplier – Vitesco. The company was able to identify the batch and initiate a recall campaign targeting just those vehicles.  "After reviewing the field data, GM determined there were 617 potentially relevant complaints, which were received between April 15, 2020 and August 24, 2021," the company's recall report said. "229 of these complaints reported a stall while standing or moving. No accidents or injuries associated with this condition were found." Any SUVs built with pumps from that batch but not yet sold are being held at dealers for replacement parts. It may take some time for GM to source replacements due to the ongoing electronic parts shortages.  "We are working with the supplier to obtain the required parts as quickly as possible," GM said in its notice to dealers. "When sufficient quantity of parts are available, the recall bulletin will be released and dealers can begin repairing vehicles."
