Chevy Volt outsells Nissan Leaf for first time since October 2013

It's been a rough summer so far for both the Chevy Volt and the Nissan Leaf, the first two plug-in vehicles from major automakers that ushered in the modern plug-in era. In June 2015, sales were down from their 2014 levels. The Leaf was down 11.6 percent and the Volt was down 31.1 percent. For July 2015, things didn't get much better. July 2015's Volt sales of 1,313 were down 35 percent from July 2014 and are down 34.8 percent for the year-to-date. Nissan, on the other hand moved only 1,174 Leafs last month, down 61.1 percent. So far this year, Leaf sales are down 30.2 percent. What's interesting with this steep decline in Leaf sales is that allowed the Volt to outsell the Leaf for the first time since October 2013. Back then, the Volt sold 2,022 compared to the Leaf's 2,002 units. So far, Nissan has sold 83,312 Leafs in the US since the EV went on sale in late 2010. Chevy has sold 80,292 Volts. Even though Tesla doesn't release monthly sales figures, there's a good chance that the pricey Model S was once again the best-selling EV in the US in July, as it was in the first three months of 2015. At that time, Tesla delivered an average of just under 2,000 Model S EVs a month. We might get some insight into more recent numbers during the quarterly investor call on Wednesday. As we've said before, the low sales for the aging plug-ins can be explained by the fact that both the Leaf and the Volt are due for upgrades. The second-gen Volt is coming in a few months. Nissan is being cagey about when the updated Leaf will arrive, but given these latest sales figures, we wouldn't be surprised if the undisclosed timetable gets move up somehow. See all seven colors available on 2016 Chevy Volt

General Motors has been happy to promote the 2016 Chevy Volt in the shiny blue color. On the company's website for the car, though, we can find all seven exterior colors, thanks to the magic of digital technology. We went through the site and played around with the option picker and put together a gallery of all the colors the new Volt will be available in as well as the five interior options. For the record, the exterior colors are: Kinetic Blue Metallic, Iridescent Pearl Tricoat, Summit White, Silver Ice Metallic, Mosaic Black Metallic, Siren Red Tintcoat, Heather Grey Metallic. You'll be forgiven if you can't quite tell the difference between the Pearl and the White in these images, but both colors have been available on the 2015 model year Volt. GM spokesperson Michelle Malcho told AutoblogGreen that buyers do have a preference, with Pearl accounting for 10 percent of the sales and Summit White accounted for 17 percent. The Pearl color is a tri-coat and thus has a $995 price premium, which was likely a factor as well. The interior of the new Volt will have two cloth options (Dark Ash and Jet Black) and three leather choices (Dark Ash, Jet Black, and Jet Black/Brandy). That last one will only be available in the LTZ trim level. You can play around with the color adjuster yourself here. Kathy Sirvio, the color and design manager of the Volt design team, told AutoblogGreen that, "Kinetic Blue is a marketing name. At Design we call it 'Blew Me Away'. That is it in a nutshell. The blue color is vibrant, rich and eye catching. It may not sell at the highest volume, as we know from history whites, blacks and silvers are the dominant color sales. However, it will tell everyone who sees it on the street that here comes a new vehicle and it is expressive in all the right ways." The next-gen Volt arrives later this year with a starting price of $33,995. The powertrain upgrades will push the all-electric range to 50 miles and the gas-only fuel economy to 41 miles per gallon. GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case.
