GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. 2016 Chevy Colorado and GMC Canyon recalled for opening console lids

The Basics: General Motors is recalling 9,200 examples of the 2016 Chevrolet Colorado with build dates between August 25, 2015 and September 24, 2015, and the 2016 GMC Canyon manufactured from August 28, 2015 to September 24, 2015. In total, 8,763 of these pickups are in the US, and the rest are in Canada or Mexico. The Problem: The console compartment lid could open in a crash, and the items inside the storage compartment might hit occupants during the accident. This fault puts the pickups out of compliance with the Federal Motor Vehicle Safety Standard. Injuries/Deaths: None reported. The fix: Dealers will replace the console compartment door latch assembly with an improved part. If you own one: GM has not yet told NHTSA when the repairs for these pickups begin. The affected vehicles have a console compartment lid latch assembly that may fail to keep the compartment door closed in the event of a crash. As such, these vehicles fail to comply with the requirements of the Federal Motor Vehicle Safety Standard (FMVSS) number 201, "Occupant Protection in Interior Impact." CONSEQUENCE: If the console compartment door does not remain closed in a crash, the contents stored in the console may strike the vehicle occupants, increasing their risk of injury. REMEDY: GM will notify owners, and dealers will replace the console compartment door latch assembly, free of charge. The manufacturer has not yet provided a notification schedule. Chevy Bolt EV with 200-mile range to debut at CES

The production version of the Chevrolet Bolt will debut at the Consumer Electronics Show in early January, according to The Verge. General Motors global product development boss Mark Reuss made the big announcement during the Los Angeles Auto Show. The Bolt made a huge splash at the 2015 Detroit Auto Show when Chevy unveiled the hatchback as a concept with the promise of a 200-mile electric range and price of roughly $30,000 – at least after possible incentives. The idea of an affordable EV from a major automaker to challenge the Nissan Leaf was certainly intriguing. The Bowtie saw the opportunity and fast-tracked the model's development. The company announced shortly after the debut at it would build the Bolt at the Orion Assembly Plant in Michigan. Camouflaged test mules suggest the production version looks very similar to the concept. The Bolt reportedly arrives at dealers in 2017, but Chevy hasn't made an official announcement yet. However, the company already has a marketing plan, and it's committed to selling the EV in all 50 states. In addition to the launch of the production Bolt, GM will have another major presence at CES because CEO Mary Barra will give the event's keynote speech. She'll reportedly discuss the automaker's new focus on personal mobility and possible cooperation with tech companies. Related Video:
