GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Nissan Leaf, Chevy Volt sales both down in June

The best news you can slice out of today's sales reports for June 2015 is that things have to get better at some point. Most likely, sales of the Nissan Leaf and the Chevy Volt will see a big increase once the second-generation models of both vehicles arrive (the Volt later this year and the Leaf, well, at some point after that). For now, though, the best-selling EVs in the US are both suffering compared to where the numbers were at last year. The numbers are also suffering compared to last month, which was the best of the year so far for both vehicles. Looking just at June, though, Leaf sales totaled 2,074 units, down 11.6 percent from a year ago (the EV sold 2,347 units in June 2014). The world's best-selling EV is now down 22.9 percent for the year so far (12,736 in 2014 vs. 9,816 in 2015). Things are a bit worse over at Chevy, where news about the pretty-much-better-in-all-ways second-gen Volt is coming out with great frequency. Nonetheless, people are still buying the outgoing Volt, snapping up 1,225 units in June. That's down 31.1 percent from the 1,777 sold in June 2014. So far in 2015, the Chevy has sold 5,622 Volts, a drop of 34.7 percent from the 8,615 Volts sold in the first six months of 2014. Electric pickups compared: 2025 Ram 1500 REV specs vs. Silverado EV, F-150 Lightning

Now that the 2025 Ram 1500 REV has been revealed, along with its most important specifications, we now have information on all of the mainline Big 3 electric full-size pickup trucks. So it's time to see how the numbers stack up, because trucks are all about numbers. We'll see how the Ram compares to the power, battery capacity, payload, towing and other features of the 2024 Chevy Silverado EV and the 2024 Ford F-150 Lightning. Power and torque The Ram has just one powertrain option. It features two electric motors making 654 horsepower and 620 pound-feet. That gives it the most powerful standard powertrain, if not the most torque, as the Chevy Silverado EV has 510 horsepower and 615 pound-feet of torque, while the F-150 Lighting has 452 horsepower and 775 pound-feet. But the Chevy and Ford each have upgraded motor combinations. The Silverado is the most potent with 754 horsepower and 785 pound-feet, and the F-150 has 580 horsepower and 775 pound-feet. The GMC Sierra EV will also be available with this more powerful pair of motors, and most of its specifications will be the same as the Silverado. There are a couple of exceptions which we'll note when they come up. All three trucks come standard with dual motors and all-wheel drive, regardless of output, battery or trim level. They're all available with locking rear differentials, too. Ford F-150 Lightning front low View 48 Photos Battery, range and charging The Ram is packing some serious packs of batteries. The standard model gets 168 kWh and an estimated range of 350 miles. And the optional 229-kWh pack is estimated to deliver 500 miles of range. That's more capacity and range than the others. It also boasts an 800-volt battery system that allows for close to 350-kW charging. The Ford F-150 Lightning has a base battery of 98 kWh with a range around 230 miles. Optional is a 131-kWh pack with between 300 and 330 miles of range, depending on other vehicle specifications. It's the slowest charger, only allowing 150-kW charging maximum. The Silverado EV's battery specs are a bit nebulous. At launch, it will only be available with one battery pack option that GM claims will provide around 400 miles of range. The company didn't give an exact capacity, though. We would guess its size falls between the Ram's 168 and 229 kWh packs. A smaller battery pack will be offered later, with a shorter but unknown range. The Silverado can use 350-kW fast charging like the Ram.
