GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Suzuki recalls 2 million cars globally

Suzuki is recalling two million vehicles across the globe, including a number of Chevrolet Cruze sedans that it builds for General Motors, because the ignition switches may begin to smoke. None of the Cruzes being recalled were sold in the US, though. This recall is limited to the Japanese, European and Australian markets. In Suzuki's home market, 1,873,000 vehicles are being recalled, including the Cruze and a number kei cars built for Mazda (the Carol and AZ-Wagon), as well as the automaker's own Alto, Wagon R and Swift. Affected vehicles were built between 1998 and 2009. The remaining 133,000 vehicles include Cruzes and other Suzuki products sold in Europe and Australia. There have been no reports of injuries or accidents due to the 67 reported incidents, all of which come from the Japanese market, a Suzuki spokesperson told Automotive News. Related Video:

Mustang retakes monthly pony car sales crown from Camaro

Going back to their origins in the Swinging '60s, the Ford Mustang and Chevrolet Camaro have been fierce rivals for fans' hearts and dollars. Historically, the Ford often led in volume, but Chevy took the muscle car top spot in 2009 upon the Camaro's rebirth. However, with the launch of the latest Blue Oval pony car, the tide is turning back in Ford's favor. November was the first full month of sales for the new 2015 Mustang, and according to TheDetroitBureau.com, the model did spectacularly well. The Blue Oval shifted 8,728 of them, up 62 percent from same month last year, with the automaker proclaiming it the model's best November sales since 2006. Conversely, 4,385 units of the Camaro were delivered, down 13.5 percent year-over-year, meaning its sales were roughly half that of the new-generation Mustang. Ford is understandably happy with the results, and product development director Raj Nair even hinted to TDB that another version of the Mustang might be unveiled at January's North American International Auto Show. Rumor has it that the model will be the even more potent Shelby Mustang GT350R. Despite the Mustang's November success, the Camaro outsells it year to day. So far in 2014, Ford has sold 73,124 Mustangs versus 79,669 examples of the Camaro. With December offering the last chance for an overtake, the Bowtie may yet remain king for this year's sales crown. A new Camaro is peeking over the horizon, as well. It's reportedly moving to the Alpha platform used by the Cadillac ATS, and production could start in late 2015. Prototypes are already testing at the Nurburgring, and camouflaged examples have been spotted weirdly being compared to its '80s forefather.
