GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Corvette + fireworks = so much glory

You might think that those of us making our living by reviewing cars, think critically about the cars we're driving most of the time. It could be that I'm an underachiever, but that's not the case with me. In fact, unless I'm set to the review task, I typically think about the cars in front of and around me more frequently. That's because a) you never know what you're going to see out there, and b) all of them could be out to bump/scratch/tailgate/crash me out. You can never be too careful. Such was the case when I was driving a 2015 Chevy Corvette earlier this week. I'd already had my fun finding the edges of grip on a river road in the car, the night before; on the morning in question I was just trying to get to work. But while scanning the suburban streets for potential dangers to the 'Vette's neat-o Daytona Sunrise orange paint, I spied a XXL-sized fireworks tent in an empty parking lot. Oh right, I remembered, 4th of July weekend. That obvious bit of observation lead to a chain of thought along these lines: "We should do something with this car for the 4th" ... "Too bad I have to give it back tomorrow." ... "Wonder if I could do a quick video?" ... "Wonder if I can set off a bunch of fireworks in slow-mo for a video?" The result, well, I won't call it genius, but I will say that I remember why every kid loves fireworks. And I will call it glorious. Happy 4th, y'all.

GM, Pilot will build EVgo fast chargers at 500 truck stops across U.S.

All of our maps showing electric vehicle charging stations across the U.S. are going to need an update. Today, General Motors, Pilot and EVgo announced plans to work together on a nationwide DC fast charging network. The plan calls for 2,000 charging stalls that can deliver up to 350 kW to be installed at up to 500 Pilot and Flying J travel centers in the U.S. The goal is to have DC fast chargers available in 50-mile intervals across the country. The new charging stations will feature GM's "Ultium Charge 360" branding and "Pilot Flying J" logos but will not be limited to drivers of GM EVs. The plugs will use CCS connectors and be available to anyone. GM EV owners can take advantage of benefits, including the ability to make exclusive reservations, get discounts on charging costs and streamline the charging process with Plug and Charge and in-vehicle apps that can provide real-time charger availability. The first installation phase will take place in 2023, and "the bulk of the installations" should be completed by 2025, EVgo CEO Kathy Zoi said during a conference call with reporters announcing the plan. "We're gonna get going immediately and commence all of that engineering and planning stuff," she said. "We've got a pretty orderly plan." Pilot CEO Shameek Konar said the company expects the new EV charging stations to coexist with the current fuel infrastructure. "An average Pilot Flying J location is about 10 acres," Konar said. "This will be in addition to all of our gas pumps. The way I think about it is, this is a new source of energy that is going to coexist with gas for quite some time. We can debate how long, but we need to serve both groups of customers." Installing DC fast chargers at hundreds of Pilot's travel centers — aka truck stops — means there should be food, drinks, restrooms, WiFi and even showers available while you wait for an EV to charge. Pilot recently announced its “New Horizons” plan that will invest $1 billion in upgrading Pilot travel centers with more premium amenities, including expanded seating and lounge areas. While the exact amount of time it will take to charge an EV using these new stations will vary on the EV and its current state of charge, most EVs can refill from a low state of charge to around 80 percent in 20-30 minutes on a fast charger. The new stations are future-proofed to deliver up to 350 kW, a charge rate that few EVs today can handle.
