GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. GM issues stop-sale for 3 SUVs over incorrect MPG rating

This week, GM sent a memo to Chevy, GMC, and Buick dealers to tell them to stop selling three SUVS. The 2016 Chevy Traverse, the GMC Acadia, and the Buick Enclave all have EPA window stickers that show higher fuel economy ratings than the vehicles actually have. Unlike other recent – and very public – fuel economy ratings problems from VW and Mitsubishi, it doesn't seem like GM did anything wrong with the testing for these vehicles, it just misprinted the labels. New labels are being printed and should arrive at dealerships this weekend and early next week. After that, the SUVs will be able to be sold and delivered again. The official fuel economy rating for the three SUVs are all the same. The correct numbers for the all-wheel drive versions are 17 miles per gallon combined, 15 city, and 22 highway. The stickers say the SUVs get 17/24/19. The front-wheel driver models were also incorrectly labeled, and the total number of affected vehicles is 59,823. In the memo, GM said the problem was caused by an "inadvertent error," Automotive News says. GM is working with the EPA to solve the issue. 2.0-liter turbo four reportedly returning to Chevrolet Equinox line-up for 2022

Chevrolet's popular Equinox crossover will enter the 2021 model year with comprehensive updates and a turbocharged, 1.5-liter four-cylinder as its only available engine. The 2.0-liter turbo four offered through 2020 is allegedly leaving the line-up, but it will be replaced for 2022 with a newer engine that produces slightly less power while returning better fuel economy, according to a recent report. Called LSY internally, the new 2.0-liter turbo four already powers the Cadillac XT4, among other models in the General Motors portfolio. Enthusiast website GM Authority learned it will deliver 237 horsepower at 5,000 rpm and 258 pound-feet of torque from 1,500 to 4,000 rpm. For context, the 2.0-liter available through 2020 (known as LTG) made 252 horses and 260 pound-feet of twist, and the 1.5-liter posts figures of 170 and 203, respectively. As a trade-off for the slight drop in horsepower and torque, the LSY is smoother, quieter and cleaner than the LTG it replaces. Transmission options remain unconfirmed, but the four-cylinder will likely shift through a nine-speed automatic. Front-wheel drive will come standard, and all-wheel drive will be offered at an extra cost. Chevrolet hasn't commented on the report; it hasn't even confirmed the Equinox is losing the LTG engine for 2021. If the rumor is accurate, details about the 2022 Equinox should be released during the first half of 2021. GM Authority added the GMC Terrain, which is closely related to the Equinox, will receive the new engine for 2022 as well.
