GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. GM recalls trucks and SUVs for brake pedal problem

The Basics: General Motors will recall over 473,000 North American examples of the 2015-2016 Chevrolet Silverado HD, GMC Sierra HD, and police pursuit versions of the Chevy Tahoe. These include 426,573 vehicles in the US and 46,837 in Canada, according to Reuters. The Problem: The brake pivot nut can loosen over time, which can render the pedal inoperative. This would be a danger to drivers trying to stop the vehicles. In some cases, the "Service Engine Soon" light might come on. Injuries/Deaths: None reported. The Fix: Dealers will inspect the pivot bolt, and if necessary they will apply adhesive to it and reinstall the part with increased torque. GM to invest $150 million in Flint to boost heavy-duty pickup production

FLINT, Mich. — General Motors President Mark Reuss said on Wednesday that the automaker is investing about $150 million at its Flint Assembly plant in Michigan to boost production of heavy duty trucks by another 40,000 vehicles a year. Reuss announced the investment at the Flint truck assembly plant wearing a United Auto Workers pin. The Detroit automaker had announced back in February it was adding 1,000 jobs in Flint to build a new generation of heavy-duty pickup trucks. GM did not say that the latest investment would add more jobs at the plant, but Reuss said there could be opportunities to add workers as the launch of the automaker's new trucks progresses. GM has been under pressure from President Donald Trump and lawmakers of both parties to add jobs in the United States after it said last November it would idle the Chevy Cruze assembly plant in Lordstown, Ohio, and likewise had no new products for three other U.S. manufacturing plants. The Flint investment will include upgrades to the plant's conveyors and other new tooling, and will be completed in the first half of 2020. GM has invested more than $1.6 billion in the plant since 2013. Last month, GM said it would invest $24 million to increase truck production at its assembly plant in Fort Wayne, Indiana, which makes Chevrolet Silverado and GMC Sierra models. Sales of heavy-duty pickups in the United States have grown to more than 600,000 vehicles a year, up more than 20 percent since 2013, according to industry data. Prices for luxury models can easily top $70,000. GM's Chevrolet and GMC brands have long trailed Ford's F-series heavy duty trucks in the lucrative segment. The new Chevrolet and GMC heavy duty trucks have been re-engineered to tow heavier trailers, and keep pace in what has become an arms race among the Detroit Three automakers to claim superior torque and towing capability.
