GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. 2016 Chevy Corvette Z06 C7.R Edition brings track style to the road

The Chevrolet Corvette has a long history of excelling at endurance racing, and continues to dominate today. To celebrate that legacy, Chevy is bringing some of the look of its track machine to the road with the 2016 Corvette Z06 C7.R Edition. These machines might be gone faster than the racecar's lap time around Le Mans, because the company is building just 500 of them. All of these track-inspired, special editions are based on the 650-horsepower, supercharged Z06 in the top 3LZ trim, and they also come equipped with the Z07 Performance Package that includes carbon-ceramic brakes, adjustable aero elements, and Michelin Pilot Sport Cup 2 tires. Offered as a coupe or convertible, these 'Vettes use some tricks to match the style of the C7.R. They're available in the racer's traditional bright yellow livery, but black is optional. Unpainted carbon fiber trim (including material for the hood) and grilles that are painted Spectra Gray Metallic also add to the motorsport look. The car rides on a set of black wheels with Corvette Racing logos on the center caps. Inside, buyers of this limited edition are nestled in Competition Sport Seats that are upholstered in Jet Black leather. Suede microfiber accents with yellow stitching cover the steering wheel, gearshift, instrument panel and doors. Plus, there's some additional carbon fiber trim for good measure. Each car also comes with a cover with C7.R graphics. Chevy isn't disclosing the price for the Z06 C7.R Edition yet, but the limited edition model is slated to hit the market later this year. They go on sale later this year. "Corvette Racing's legacy and technology were significant influences on the development of the Corvette Z06 and the new C7.R Edition honors the direct link between the racecar and the production model," said Harlan Charles, Corvette product and marketing manager.

New 2016 Chevy Volt ad arrives in time for Tomorrowland

As summer approaches, so do the blockbusters. We've already seen Furious 7 and The Avengers: Age of Ultron, while Mad Max: Fury Road arrives this week. Next week's big debut is Disney's Tomorrowland, starring George Clooney, and not surprisingly, the advertising campaign is kicking into gear. Perhaps attempting to capitalize on the high-tech theme of the flick, Chevrolet has teamed up with Disney for the second-generation Volt's very first commercial appearance. As we reported previously, the Volt will star on the big screen when Tomorrowland hits theaters, and it will be accompanied by the EN-V Concept. Take a look at the Volt's Tomorrowland spot, up top.
