GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Our picks here are the delightfully Targa-like MX-5 Miata RF and literally any Corvette Stingray — even the hardtop has a removable roof!    For long road trips: 2022 Ford Mustang Convertible ($34,100) The first image that comes to mind for many who are told to visualize an American convertible is the classic Ford Mustang. It's not the only drop-top pony car out there, but thanks to the Camaro's tiny trunk, it's much harder to see the USA in a Chevrolet when a drop-top enters the equation. The Mustang has much more cargo space and a much larger opening, which is likely the difference between keeping your bags under lock and key or leaving them exposed in the back seat.    For towing behind an RV: 2022 Jeep Wrangler ($31,590) While many small runabouts make sense for towing behind a motor home (or nestled up inside a fancier one), the Wrangler has a serious advantage when it comes to RVing: it can easily be flat-towed.

Nissan Leaf sells 3,186 in best month ever as Chevy moves 2,511 Volts

The end of summer seems to inspire people to go out and buy a lot of plug-in vehicles. Last year, for example, the Chevy Volt had its best month ever in August, with 3,351 sales. This year, the Nissan Leaf is going up to the winner's podium, setting its own best-ever record with 3,186 units sold. This beats the Leaf's previous record by 69 vehicles. This beats the Leaf's previous record of 3,117 set in May 2014 by 69 vehicles and is up 31.7 percent from August 2013. Nissan is once again quick to remind us that the popular EV's record sales streak has now been extended to 18 months in a row. This record is simply noting that the current month, in this case August, had the highest sales that that month has ever seen in the US. Over all, US Leaf sales are up 34.1 percent so far this year. In a prepared statement, Nissan's director of Leaf sales and infrastructure, Brendan Jones, said that the Leaf is selling well on both coasts, including cities like Raleigh, Boston and Washington, DC. "It's what we call the 'cul-de-sac phenomenon,' where once someone in a community buys a Leaf, then friends, family, co-workers and neighbors see the benefits of this fun-to-drive electric vehicle firsthand and are sold on the idea of going electric," he said. The Volt also had a good month - its best of 2014 by almost 500 sales – but the 2,511 Volt sales still represent a drop of 25.1 percent from the excellent sales the Volt had this time last year. In fact, August 2014 represents the Volt's best sales month since, well, August 2013. Apparently, there's just something about the end of summer.
