GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. When General Motors created the Geo brand to sell vehicles designed and — in some cases — built by Japanese partners, the first four models were introduced for the 1989 model year: the Metro (Suzuki Cultus), Prizm (Toyota Sprinter), Spectrum (Isuzu Gemini) and Tracker (Suzuki Sidekick). Geo got the axe in 1997, with the Metro, Prizm and Tracker becoming Chevrolets. Of those, the Tracker survived the longest, with U.S.-market sales continuing into 2004. Here's an example of a very late Tracker, found in a North Carolina car graveyard recently. The 1989-1997 first-generation Trackers were based on the Suzuki Sidekick, while the 1998-2004 Trackers had the Suzuki Vitaras (not to be confused with the much grander Grand Vitaras) as their siblings. Production of these trucks for the South American market (as the Chevrolet Vitara) continued in Ecuador all the way through 2014. The Tracker name has also gone onto some versions of the Chevrolet Trax around the world. This one is a base four-door hard top/rear-wheel-drive model, which had an MSRP of $17,330. That's about $29,789 in 2024 dollars. You'll find one in every car. You'll see. The engine is a Suzuki 2.0-liter straight-four rated at 127 horsepower and 134 pound-feet. A five-speed manual was base equipment, but very few American vehicle shoppers wanted three pedals by the middle 2000s. This truck has the Aisin four-speed automatic. We like it loud. It appears that someone associated with this truck graduated from Julius L. Chambers High School last year. In the United States, the Tracker was replaced by the Saturn Vue. If Tracker can handle (unspecified Middle Eastern country), it can survive the jungle back home. Siempre contigo.

GM recalling 426,000 sedans over faulty transmission shift cable

General Motors is recalling some 426,240 sedans that may have a faulty transmission shift cable, according to a National Highway Traffic Safety Administration report this morning. The recall concerns a fault within four-speed automatic transmissions equipped on 2007-2010 Saturn Aura models, and 2008-2010 Chevrolet Malibu and Pontiac G6 models.
The report specifies that tabs on the transmission shift cable may fracture and separate. Such a fault could cause a discrepancy between the actual position of the transmission and the apparent position of the shift lever.
GM is currently working to notify owners of the vehicles in question, and dealers will check and replace shift cables free of charge. Scroll down to read the complete NHTSA report.
