GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. GM: Without LG Chem, we couldn't build Bolt EV [UPDATE]

It's absolutely no surprise that General Motors has a thing for LG Corp. The Detroit automaker and the Korean parts supplier have been working in public on electric vehicles ever since it was announced that LG Chem would supply the battery cells for the Chevy Volt in 2009. LG Chem was even named GM's 2010 Supplier of the Year. But, yesterday, the connection between the two companies was strengthened with the announcement that LG Electronics would be supplying a number of components for the upcoming Chevy Bolt electric vehicle. The Bolt is expected to be able to go about 200 miles and will carry a price tag of about $30,000 (after incentives) when it arrives in 2017 or so. LG's new components can be found almost everywhere in the Bolt. They include the battery pack and the battery heater, a new motor, the power inverter module, the electric climate control system compressor, the on-board charger, high-power distribution module, the accessory power module, and power line communication module. Oh, and then there are LG Electronics' advanced display technologies like the new instrument cluster and a new infotainment cluster. LG Electronics also supplies parts for the 4G LTE OnStar system, just like it does in other new Chevys. If that all sounds like a lot of components to you, you're right. Mark Reuss, GM executive vice president of global product development, purchasing and supply chain, said that without the expanded relationship with LG, GM would not be able to bring the Bolt to market (insert old ironic quote link here). "I think GM was lacking that [electrification knowledge] in a very complete way for many years, I'll just be frank about that," Reuss said. "I also think that on an electrified basis, this requires a long-term commitment and trust that sometimes is violated on a more short-term, regular, traditional basis. I think we have found something completely different with LG and I think that has become a widely talked about and duplicated want from our purchasing and corporate standpoint with our supply base." The "this" that Reuss is talking about here is the OEM-supplier relationship, something has evolved with the LG-GM situation. Previously, the automaker-supplier relationship used to be more like a dictator telling underlings what he needed, Reuss said, and that was a bad idea. "Today's competitive landscape requires a different approach, especially in electrified vehicles," he said.

Forza Motorsport 6's new drivable Hot Wheels cars are the best

Each month, Turn 10 Studios releases a new car pack for the latest installment of its Forza Motorsport video game. Sometimes that means less-than-exciting stuff coming to our Xbox Ones – BMW X6M, bleh – but this time our inner seven-year-old is beyond ecstatic. Two of the seven cars are based on actual Hot Wheels models. And. They're. Awesome. First we have the 2011 Hot Wheels Bone Shaker. Yes, there are flames on the side. And yes, there's a giant skull where the grille should be. This one came from the imagination of "Mr. Hot Wheels" Larry Wood, whose design was so popular it inspired an actual real-world creation. Like all good things in this world, it's powered by a small-block Chevy V8. Oh, and it has no roof. This will be a popular one among gamers. The other digitized Hot Wheels creation is a 2005 Ford Mustang. A modest vehicle, sure, but the toy designers have festooned this pony car with a wild paint scheme and the body mods to emphasize it. Originally developed to celebrate the 'Stang's 50th birthday, this Hot Wheels car trades Americana for wild Japanese style. There's just one functioning life-size version of this car in existence as well, but if you look hard, you might be able to find one of the 1:64 scale models that inspired it. Other highlights from this month's car pack include the latest Ford Focus RS – finally time to replace that NASCAR-V8-powered, all-wheel-drive 2009 Focus RS – the 2015 McLaren P1 GTR, the 2016 Chevrolet Camaro SS, the aforementioned X6M, and Alain Prost's 1990 Ferrari 641 F1 car.
