GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Let's Drive NYC is GM's car sharing program for the Big Apple

Under a new car sharing program offered by General Motors and others, a New York Minute will cost about 15 cents. GM is working with a luxury-apartment building owner and a parking lot operator to run a car sharing program in Midtown Manhattan. The program is called Let's Drive NYC and it was announced Thursday. Let's Drive NYC is being offered to residents of the Ritz Plaza, a 479-unit luxury apartment building near New York's Times Square. The program is being run with the help of Icon Parking Systems, which runs about 200 parking garages in Manhattan where the cars can be parked. GM is contributing eight Chevrolet Trax crossovers and two Chevrolet Equinox SUVs, and the automaker is slated to add more vehicles "later." Residents of the Ritz Plaza, which is owned by Stonehenge Partners, can make "periodic apartment lease payments" and in exchange receive electronic credits for three hours of driving a month. After those three hours are up, the drivers will be charged less than $10 an hour, or as much as $75 a day. The program was piloted earlier this year to some of the apartment's tenants. The program marks the second bit of car sharing news in New York within the past two months. In August, Mercedes-Benz and Smart parent Daimler announced that its Car2go car sharing service would expand into Queens and add about 100 Smart ForTwo two-seaters to the city's program. Fernando Alonso sputters in his Indy test

INDIANAPOLIS — Helio Castroneves and Fernando Alonso kept waiting around Wednesday. Now both international stars have some unfinished business to take care before qualifying for this year's Indianapolis 500. After enduring a rain delay of more than four hours then watching IndyCar regulars turn laps at Indianapolis Motor Speedway for two more hours, Castroneves and Alonso finally made it onto the track — but couldn't quite complete their refresher course. "Happy to be back here because this place is great," Alonso said after posting a fast lap of 218.690 mph — the slowest of the nine-driver evening session. "We were slow because the weather and some of the decisions people made on running time and things like that." He faced a bevy of problems in his first trip back to Indy since an impressive rookie performance in 2017. The rain delay forced organizers into rescheduling the one-day test, moving the rookie and refresher driver time from midday to the evening, cutting a significant amount of practice time for Alonso and the others. And when the green flag finally waved, Alonso's No. 66 car stalled in the warmup lane forcing the two-time Formula One champion from Spain to be towed back to pit lane where his crew worked feverishly to fix an electrical problem while sat in the cockpit. Eventually, he did get out and passed the first of two refresher phases. He'll have to wait until opening practice of the 500 on May 14 to pass the second. "It was frustrating for everyone because it was a brand new chassis and a brand new car, so we expected to run a lot," said Alonso, who drives for McLaren Racing. "If we could have had this at midday, you could work on your issues in the afternoon and then go out again." To put his day in perspective, Takuma Sato, the 2017 Indy winner from Japan, posted the fastest lap of the day at 226.993 mph and Colton Herta was the fastest rookie at 226.108. Castroneves, as usual, was good right from the start and posted a fast lap of 225.565. The three-time Indianapolis 500 winner looked smooth and fast on his favorite track and wasted no time passing the first phase. That much should have been expected from the popular Brazilian, who has recorded seven top-three finishes in 18 Indy starts and will make his season debut May 11 in the IndyCar Grand Prix. The weather and yellow flags prevented four of the five veterans — Castroneves, Alonso, Oriol Servia and JR Hildebrand — from passing phase two. Only Indy native Conor Daly made it.
