GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Recharge Wrap-up: NEDC's NOx problems, autonomous Chevy Volts

The International Council on Clean Transportation (ICCT) found a significant difference in NOx emissions in Euro 6 diesel cars in NEDC and WLTC testing. While 88 percent of the cars tested met emissions standards for NEDC, NOx emissions averaged five times higher under WLTC, with only 27 percent of vehicles under the limit. WLTC is considered to be a more realistic driving cycle, using hot starts and factoring a higher top speed as well as harder and more frequent accelerations than the NEDC. Read more at Green Car Congress.GM Canada will build a fleet of autonomous 2017 Chevrolet Volts. The self-driving Volts will be deployed for testing at GM's Warren, Michigan Technical Center. Employees will be able to use a carsharing app to reserve a car, which will then drive itself to the set destination. The project will allow GM to collect important data and experience to help the company more quickly develop autonomous driving technology. Circular economy at work with electric vehicles When, over time, the batteries of a Renault electric vehicle fall the performance threshold specified for their initial automotive power duty (around 75% of initial capacity), they can still provide valuable service in "second-life" applications before end-of-life disposal at a recycling centre. Experiments are already under way on power storage applications, for example.

You get a ton of features for the money as well as a very generous warranty. Holding it back is its rather weak engine and very tiny proportions. Honorable mentions: 2024 Chevrolet Trax: $21,495 2024 Kia Soul: $21,565 Cheapest midsize SUV: 2024 Chevrolet Equinox Compact SUVs have the broadest appeal thanks to a very diverse group. It seems as though there's a great pick for nearly every taste, whether you're seeking something sporty, rugged or luxurious. They're a great pick for small families with one child and/or a dog. The class is led by vehicles that include the Honda CR-V, Kia Sportage and Mazda CX-50, which are still within reach of most shoppers' budgets. 2024 Chevrolet Equinox: $27,995 The Equinox debuted back in 2005 and this current third-generation was last redesigned in 2018, though a new one is right around the corner for the 2025 model year. While the current 2024 model may be showing its age, it still deserves your consideration for its comfortable ride quality, confident cornering and roomy passenger space.
